MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT:
Having carefully reviewed this application, we agree with the recommendation of the Air
Force Evaluation and adopt the rationale expressed as the basis for our decision that the applicant
has been the victim of either an error or an injustice. Therefore, under the authority aelegated in
AFI 36-2603, the applicant's records will be corrected as set forth in the accompanying
Memorandum for the Chief of Staff signed by the Executive Director of the Board or his
designee.

Requested Action. The applicant requests the Board remove the letter he wrote to the
CY98B (6 Apr 98) (P0498B) central major selection board president.

Basis for Request. The applicant’s officer selection record (OSR) has been corrected and
the letter to the P0498B board president is no longer necessary.
Recommendation. Approval.
Facts and Comments:
a. The appeal is timely. Application under AFI 36-240 1. Correcting Officer and
Enlisted Evaluation Reports, 1 Dec 97, is not appropriate as the issue raised in this appeal is not
within the purview of that directive. The applicant has two nonselections to the grade of major
by the CY97C (1 6 Jun 97) (P0497C) and P0498B boards.
b. AFI 36-2501, Officer Promotions and Selective Continuation, 6 Mar 98, is the
governing directive.
e. The applicant filed an appeal under AFI 36-240 1, requesting he receive special
selection board (SSB) consideration by the P0497C and P0498B boards with the removal of an
AF Form 475, Training Report, closing out 9 Jun 96, from his OSR. His request was approved
by the Evaluation Report Appeal Board, and he is tentatively scheduled to receive SSB
consideration for the P0498B board in May 99 (the applicant is currently scheduled to receive
SSB consideration for the P0497C board in Jan 99). As such, we request the Board make a
decision on this appeal as expeditiously as possible.
d. The applicant now requests the Board remove the letter he wrote to the
P0498B board president explaining the misleading AF Form 475. Since the AF Form 475 is no
longer a part of his OSR, the applicant’s letter is no longer necessary. We, therefore, would not
be opposed to the Board granting the applicant’s request to remove the letter from his OSR prior
to his SSB consideration tentatively scheduled in May 99.
Summary. Based on the evidence provided, our recommendation of approval is
appropriate.

While the delay was not in violation of the applicable regulation, we believe that had it not been for the two-year backlog of awards the squadron had to deal with, the AAM would have been awarded sooner and placed in his record prior to the convening of the CY97C selection board. AIR FORCE EVALUATION: The Chief, Appeals & SSB Branch, AFPC/DPPPA, reviewed this application and indicated that promotion nonselection is not an issue. In ~yinstance, the applicant failed to provide a letter of support from the rater of the contested report. But the time to do that is before the report becomes a matter of record.
We note that the duty history portion of the CY98 officer selection brief (OSB) correctly indicated the applicant’s duty location as CENTCOM, therefore, the information was available for the promotion board’s review.
