After  careful  consideration  of  applicant's  request  and  the 
available  evidence of  record, we  find  insufficient evidence  of 
error or injustice to warrant corrective action.  The facts and 
opinions stated in the advisory opinion appear to be based on the 
evidence  of  record  and  have  not  been  rebutted  by  applicant. 
Ab^sent persuasive evidence applicant was denied  rights to which 
entitled,  appropriate  regulations  were  not  followed,  or 
appropriate  standards  were  not  applied,  we  find  no  basis  to 
disturb the existing record. 
Accordingly, applicant's request is denied. 

The Board staff is directed to inform applicant of this decision. 
Applicant should a l s o  be informed that this decision is final and 
will only be reconsidered upon the presentation of new relevant 
evidence  which  was  not  reasonably  available  at  the  time  the 
application was filed.

Correction of Military Records 

The attached Application for Correction of Military Records submitted by the 

applicant, a member of the New York Air National Guard, is forwarded for your 
review and action. 

This headquarters recommends denial.  The applicant requested his Date of 

Rank (DOR) be adjusted based on a Revised Extended Unit Manpower Document 
(EUMD) and Support Personnel Manpower Document (SPMD) for the National 
Science Foundation (NSF) Mission for the 109th Arlift Wing (A&). These 
documents were provided to the 109th AW for planning purposes of their UMD 
growth.  We allow organizations that authority to appoint, assign, enlist, reenlist or 
extend to fill projected UMD growth positions up to 24 months in advance of the 
effective date of a UMD growth position to allow for training purposes, this 
authority can be found in ANGI 36-2101, paragraph 2.2.5.3.  We have not nor do we 
grant authority to promote based upon projected growth for increased promotion 
potential.  T h s  basis for this ruling is the Unit Manning Document (UMD) position 
must be officially reflected on the base level UMD, which provides the funding for 
promotion.  ANG MPM letter dated 30 Apr 97 also addressed t h s  issue as follows; 

“Note that we have opted to grade the NSF mission 
“separately” which enhances the grades.  Had we assessed 
the grades for the mission embedded in the 109thTHW 
unit the grades would have been lower.  All military 
documents, to include “AGR only” programs, are subject 
to review upon implementation of “Grade Justification” 
ANG wide.”
