APPLICANT REQUESTS THAT:
He be given a colonel Certificate of Eligibility (COE) for both
the Spring and Fall 2010 Air National Guard (ANG) Federal
Recognition Examination Board.

APPLICANT CONTENDS THAT:
He met the requirements; however, he was never boarded for a COE
in accordance with ANGI 36-2504, Federal Recognition of
Promotion in the Air National Guard and as a Reserve of the Air
Force Below the Grade of General Officer paragraph 3.5 and 3.6.
His commander made his intentions known in May 2010; however,
other officials failed to act and did not follow the process and
this has caused a serious set-back in his ANG career.
In support of his request, the applicant provides copies of
email communiqué.

STATEMENT OF FACTS:
The applicant is presently serving in the grade of lieutenant
colonel having assumed that grade effective and with a date of
rank of 4 Nov 06 and effective date of 30 Apr 07.
AFI 36-2504 states, Officers considered for position vacancy
promotion to the grade of colonel must be assigned to an
appropriate unit manpower document (UMD) position. UMDs will not
be changed and States will not be authorized to exceed
established colonel authorization ceiling. States are required
to submit their officers for promotion consideration by one of
the two boards convened each year for officer promotions to the
grade of colonel. Complete recommendations will be forwarded to
ANG/DP, not later than 15 January for the Spring Board and not
later than 15 July for the Fall Board, for personnel found
qualified by a Federal Recognition Examination Board. Packages
arriving at ANG/DP after the dates stated will be held for the
subsequent ANG Colonels Federal Recognition Review Board.

AIR FORCE EVALUATION:
NGB/A1POP states there is no action they can take or relief they
can grant since the TX ANG has never submitted the applicant for
promotion to the grade of colonel.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
He disagrees with the NGB/A1POP evaluation and believes the
commanders intent was not supported and the individuals
responsible should be investigated for not doing their jobs.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion the applicant has not
been the victim of an error or injustice. Further, we note the
applicant failed to provide any evidence showing a
recommendation package was submitted by his rating chain.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.
