TO SUPPORT HIS REQUEST THE MEMBER PRESENTED TESTIMONY AND COPIES OF HIS V.A. THE RECORD DOCUMENTS THAT THE MEMBER HAD CHRONIC LEFT SHOULDER KNEE, AND FOOT PAIN THAT LIMITED HIS ACTIVITIES DUE TO THE ABOVE DIAGNOSES. THE TDRL EVALUATION INDICATES THAT SINCE PLACEMENT ON THE TDRL THE MEMBER HAS UNDERGONE A LEFT ROTATOR CUFF REPAIR IN OCTOBER 1998 BUT CONTINUES TO HAVE CHRONIC SHOULDER PAIN.

To date, both ankles continue to click and swell as well as both knees. Bilateral knee ROM was noted as approximately 0-130 degrees.At the VA Compensation and Pension examinationperformed 5 months after separation, the CI reported right greater than left knee pain and weakness. RECOMMENDATION : The Board, therefore, recommends that there be no re-characterization of the CI’s disability and separation determination.

Although the PEB adjudicated “bilateral knee” as the unfitting condition, the record of proceedings reflects separate codes and ratings for each knee, with application of the bilateral factor in computing the combined rating, which is consistent with VASRD standards. Condition 3 : Other Conditions After careful consideration of all available information, the Board unanimously concluded that the CI’s condition is appropriately rated at a combined 20% for right and left knee osteoarthritis and no recharacterization of the CI’s disability and separation determination is warranted.
