      The Army Discharge Review Board reviewed your case and determined

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 28 September 1998, the applicant
was charged with wrongfully using marijuana between (980725 and 980825).
On
25 January 1999, the applicant voluntarily tendered his resignation from
the service under the provisions of Chapter 3, AR 600-8-24, resignation for
the good of the service in lieu of trial by a general court-martial.  The
unit and intermediate commanders recommended approval of the applicant’s
resignation for the good of the service citing an administrative discharge
would be more expeditious than a general court-martial.  On 25 January
1999, the senior intermediate commander recommended approval of the
applicant’s request for resignation in lieu of general court-marital with
issuance of an under other than honorable conditions discharge.  On 11
March 1999, the Deputy Assistant Secretary (Army Review Boards) approved
the recommendation of the Army Ad Hoc Review Board to accept the
applicant’s resignation for the good of the service with issuance of a
characterization of service of general, under honorable conditions.  DA
Message, DTG 151049Z MAR 99, from CDR PERSCOM ALEXANDRA VA//TAPC-PDT-PM//
approved the applicant’s resignation for the good of the Service under the
provisions of Chapter 3, AR 600-8-24.

      b.  On 31 March 1999, the applicant was discharged.  At the time of
discharge, the applicant had completed 5 years, and 6 months of active
military service in the period under review and had a total of 10 years, 7
months and
28 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army regulation 600-8-24
prescribes the policies and procedures governing the transfer and discharge
of Army officer personnel.  Chapter 3, Paragraph 3-13 outlines the rules
for processing request for resignation for the good of the Service in lieu
of trial by a general court-martial.

                   issue of propriety to change the discharge.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s period of service under review and heard his testimony.  There
was a full consideration of all faithful and honorable service as well as
the infraction of discipline, the extent thereof, and the seriousness of
the offense.  The Board does not condone the applicant’s misconduct;
however, it determined that the discharge is now inequitable.
Notwithstanding the propriety of the applicant’s discharge, the Board found
that the applicant’s misconduct was mitigated by post-service conduct and
achievements of sufficient merit to overcome the characterization of
service granted.  In view of the foregoing, and the elapse of time, the
Board voted to grant relief in the form of an upgrade to the
characterization of service to fully honorable.  The Board found that the
reason for discharge was both proper and equitable, and voted not to change
it.
