      The Army Discharge Review Board reviewed your case and determined
that relief is warranted.  The Board has directed the ARBA Support
Division, St. Louis, MO, to take action as indicated on the enclosed OSA
Form 172, Case Report and Directive.  This document reflects the findings,
conclusions, and reasons for the Board's decision.  The official
notification of any change to your official military personnel record,
including the appropriate documentation, will be mailed to you by the ARBA
Support Division.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that directive.  You should
read Enclosure 5 of that directive before submitting a complaint.  The
complaint procedure does not permit you to challenge the merits of the
decision, but is designed solely to ensure that the decisional document
meets applicable requirements for clarity and responsiveness.  You may

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 14 March 2001, the applicant was
notified of initiation of elimination proceedings under the provisions of
Chapter 4, AR 600-8-24, by reason of misconduct, moral or professional
dereliction.  The applicant was directed to show cause for his retention in
the Army after testing positive for cocaine use.  He was advised that he
could submit a voluntary resignation in lieu of elimination or submit a
rebuttal and request an appearance before a Board of Inquiry.  On 11 July
2001, the applicant appeared, with counsel, before a Board of Inquiry (Show
Cause Board).  The Board found that the applicant committed an act of
personal misconduct by wrongfully using cocaine and that he engaged in
conduct unbecoming an officer.  The Board recommended separation with a
general, under honorable conditions discharge.  The Ad Hoc Review Board
recommended that the applicant’s elimination be accepted with issuance of a
general, under honorable conditions discharge.  On 30 April 2002, the
Deputy Assistant Secretary (Army Review Boards) approved the recommendation
of the Army Ad Hoc Review Board and directed that the applicant be
discharge with a characterization of service of general, under honorable
conditions.

      b.  On 5 June 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 6 years, 1 month, and 2 days of
active military service in the period under review and had a total of 15
years, 3 months and
1 day of military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 600-8-24
sets for the basic authority for Officer transfers and discharges.  Chapter
4 outlines the policy and procedure for the eliminating officer from the
active Army for substandard performance of duty, misconduct, moral or
professional dereliction, and the interest of national security.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s official record for the period of service under review.  There
was a full consideration of all faithful and honorable service as well as
the infraction of discipline, the extent thereof, and the seriousness of
the offense.  The Board does not condone the applicant’s misconduct;
however, it determined that the characterization of service is too harsh.
The applicant's misconduct was mitigated by service of sufficient length
and merit to warrant an upgrade of the discharge being reviewed.
Accordingly, the Board voted to grant relief in the form of an upgrade of
characterization of service to fully honorable.  The Board determined that
the reason for discharge was fully supported in the record, and voted not
to change it.
