      The Army Discharge Review Board reviewed your case and determined

conclusions, and reasons for the Board's decision.  The official
notification of any change to your official military personnel record,
including the appropriate documentation, will be mailed to you by the ARBA
Support Division.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that directive.  You should
read Enclosure 5 of that directive before submitting a complaint.  The
complaint procedure does not permit you to challenge the merits of the
decision, but is designed solely to ensure that the decisional document
meets applicable requirements for clarity and responsiveness.  You may

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of

review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 16 October 2002, the applicant
was charged with dereliction of duty by not changing the address of his
family members and failing to insure that his soldiers, to include himself,
were receiving the proper amount of BAH; and, wrongfully appropriating
military property, the value of $41,600.  On 17 October 2002, the applicant
voluntarily tendered his resignation from the service under the provisions
of Chapter 3, AR 600-8-24, resignation for the good of the Service in lieu
of trial by a general court-martial.  The chain of command recommended
approval of the resignation for the good of the service with issuance of an
under other than honorable conditions discharge.  The Ad Hoc Review Board
recommended that the applicant’s resignation be accepted with issuance of
an under other than honorable conditions discharge.  On 20 December 2002,
the Deputy Assistant Secretary (Army Review Boards) approved the
recommendation of the Army Ad Hoc Review Board and directed that the
applicant be discharge with a characterization of service of under other
than honorable conditions.

      b.  On 28 January 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 9 years, 7 months, and 17 days of
active military service in the period under review and had a total of 18
years, 7  months and 22 days of total military service.

2.  Legal/Regulatory Basis for Separation Action:  Army regulation 600-8-24
prescribes the policies and procedures governing the transfer and discharge
of Army officer personnel.  Chapter 3, Paragraph 3-13 outlines the rules
for processing request for resignation for the good of the Service in lieu
of trial by a general court-martial.

                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

        (1)  The issue is rejected.  The Board determined that the reason
for discharge was fully supported in the official record and voted not to
change it. The evidence of record shows the applicant was charged with the
commission of offenses punishable under the Uniform Code of Military
Justice (UCMJ).  The Board noted that, after consulting with defense
counsel, the applicant voluntarily tendered his resignation from the Army.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s official record for the period of service under review.  There
was a full consideration of all faithful and honorable service as well as
the infractions of discipline, the extent thereof, and the seriousness of
the offenses.  The Board found that the length and quality of the
applicant’s service partially mitigated his misconduct.  In view of the
foregoing, the Board determined that the characterization of service was
inequitable.  Accordingly, the Board voted to grant partial relief in the
form of an upgrade of characterization of service to general, under
honorable conditions.
