PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 4 October 1989, the applicant was charged with two specifications of violation of Article 111, UCMJ, (i.e., operating a passenger car while drunk and causing said vehicle to injure a person, and driving a passenger car with two bald tires in a reckless manner by driving at excessive speed for wet road conditions and causing said vehicle to injure a person. On 6 December 1989, the applicant voluntarily tendered his resignation from the Army for the good of the Service under the provisions of Chapter 5, AR 635-120, by reason of Conduct Triable by Court-Martial. The appropriate authorities reviewed the proposed separation action and recommended approval with an honorable discharge. On 11 January 1990, the Ad Hoc Review Board recommended that the applicant’s resignation for the good of the service be accepted with issuance of an honorable discharge. On undated, having considered the recommendation of the Army Ad Hoc Review Board, the Deputy Assistant Secretary (Army Review Boards) accepted the applicant’s resignation for the good of the service; however, directed issuance of a general, under honorable conditions discharge.

         b. On 6 March 1990, the applicant was discharged. At the time of discharge, the applicant had completed 14 years, 11 months, and 22 days of active military service in the period under review and had a total of 15 years, 2 months and 28 days of active military service.

Legal/Regulatory Basis for Separation Action : Army regulation 635-120, in effect at the time, prescribed the procedures for the resignation of commission officers. Chapter 5 allowed for an officer to submit a resignation for the good of the Service (RFGOS) in lieu of court-martial. An officer separated under this paragraph normally receives characterization of service of general, under honorable conditions or under other than honorable conditions.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board does not condone the applicant’s misconduct; however, determined that the characterization of service is inequitable. The Board noted that the applicant’s misconduct, although serious, was isolated in nature and was an aberration in an otherwise noteworthy record. The Board also noted that the entire chain of command and the Army Ad Hoc Review Board recommended that the applicant’s resignation be accepted with an honorable discharge. In view of the foregoing, the Board voted to upgrade the applicant’s characterization of service to fully honorable. However, the Board found that the reason for discharge was fully supported by the record and voted not to change it.
