      The Army Discharge Review Board reviewed your case and determined

conclusions, and reasons for the Board's decision.  The official

Support Division.

decisional document requirements of DoD Directive 1332.28, you may submit a

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 24 March 2002, the applicant was
charged with submitting a false DA Form 1059 (Service School Academic
Evaluation Report), two specifications.  On 15 April 2002, the applicant
voluntarily tendered his resignation from the service under the provisions
of Chapter 3, AR 600-8-24, resignation for the good of the Service in lieu
of trial by a general court-martial.  The chain of command recommended
approval of the resignation for the good of the service with issuance of an
under other than honorable conditions discharge.  The Ad Hoc Review Board
recommended that the applicant’s resignation be accepted with issuance of a
general, under honorable conditions discharge.  On 24 June 2002, the Deputy
Assistant Secretary (Army Review Boards) approved the recommendation of the
Army Ad Hoc Review Board and directed that the applicant be discharge with
a characterization of service of general, under honorable conditions.

      b.  On 19 July 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 7 years, 1 month, and 7 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army regulation 600-8-24
prescribes the policies and procedures governing the transfer and discharge
of Army officer personnel.  Chapter 3, Paragraph 3-13 outlines the rules
for processing request for resignation for the good of the Service in lieu
of trial by a general court-martial.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board found that the length and quality of
the applicant’s service mitigated his misconduct.  In view of the
foregoing, the Board determined that the characterization of service is too
harsh.  Accordingly, the Board voted to grant  relief in the form of an
upgrade of characterization of service to fully honorable.  The Board found
that the reason for discharge was both proper and equitable, and voted not
to change it.

    Inasmuch as the Board voted to grant the full relief requested,
