conclusions, and reasons for the Board's decision. The official
notification of any change to your official military personnel record,

Support Division.

PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 8 July 1993, the applicant
was charged with disrespect to a superior officer; stealing a sweatshirt
from AFEES; and, stealing military property, 18 specifications. On 21 July
1993, the applicant voluntarily tendered his resignation from the Army for
the good of the Service under the provisions of Chapter 5, AR 635-120. The
appropriate authorities reviewed the proposed discharge action and
recommended approval with an under other than honorable conditions
discharge. On 2 September 1993, the Ad Hoc Review Board recommended that
the applicant’s resignation for the good of the service be accepted with
issuance of an under other than honorable conditions discharge. On 2
September 1993, the Deputy Assistant Secretary (Army Review Boards)
approved the recommendation of the Ad Hoc Review Board that resignation for
the good of the service be accepted with discharge under other than
honorable conditions.
b. On 30 September 1993, the applicant was discharged. At the time
of discharge, the applicant had completed 12 years, 3 months, and 10 days
of active military service in the period under review and had a total of 16
years, 5 months and 29 days of military service.
2. Legal/Regulatory Basis for Separation Action: Army regulation 635-120,
in effect at the time, prescribed the procedures for the resignation of
USAR commission officers on active duty. Chapter 5 allowed for an officer
to submit a resignation for the good of the Service (RFGOS) in lieu of
court-martial. An officer separated under this paragraph normally receives
characterization of service of general, under honorable conditions or under
other than honorable conditions.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.
b. Equity: The parenthetical number(s) below correspond(s) to
the issue number(s) on the DD Form 293, or in Part VI,
Paragraph 1, above.
(1-5) The issues are rejected. The Board carefully reviewed the
applicant’s record during the period of service under review. The evidence
of record shows that the applicant was charged with the commission of
offenses punishable under the Uniform Code of Military Justice with a
punitive discharge. The applicant voluntarily requested resignation in
lieu of trial by court-martial under the provisions of Chapter 5, AR 635-
120. The Board noted the applicant’s contentions; however, his contentions
relate to evidentiary and procedural matters which should have been raised
and conclusively adjudicated at the time of his discharge, and furnish no
basis for a change in his reason for discharge. The Board found that the
reason for discharge was both proper and equitable, and voted not to change
it. See response to issue (6), below.
(6) The issue is accepted. The Board does not condone the
applicant’s misconduct; however, determined that the characterization of
service is now inequitable. Notwithstanding the propriety of the
applicant’s discharge, the Board found that the applicant’s misconduct was
partially mitigated by the overall length and quality of his service; the
time elapsed since his discharge; and, the evidence of exemplary post-
service conduct and achievements. In view of the foregoing, the Board
voted to grant partial relief in the form of an upgrade to the
characterization of service to general, under honorable conditions. The
Board determined that the applicant’s misconduct diminished the quality of
his service below that meriting a fully honorable discharge.
