PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 11 May 1995, the applicant
acknowledged that she received the required pregnancy counseling by the
unit commander and understood her entitlements and responsibilities. The
applicant was given seven (7) days to elect to remain on active duty or
request voluntary separation. On 19 May 1995, she elected separation for
reason of pregnancy. On 12 June 1995, she submitted her DA Form 4187
(Personnel Action) requesting voluntary separation under the provisions of
Chapter 8, AR 635-200, by reason of pregnancy. The unit and intermediate
commander recommended approval of the applicant’s request. The separation
authority approved the discharge action. The record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty), which was authenticated by the applicant’s signature. Her DD Form
214 indicates that she was discharged under the provisions of Chapter 8, AR
635-200 by reason of pregnancy, with a characterization of service of
honorable.
b. On 5 July 1995, the applicant was discharged. At the time of
discharge, the applicant had completed 2 years and 8 days of active
military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 8 establishes policy and procedures for voluntary separation of
enlisted women because of pregnancy. If an individual is beyond entry-
level status, her service will be characterized as honorable or general,
under honorable conditions.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
The evidence of record does not support the applicant’s contentions and
the applicant has provided no independent corroborating evidence in support
of her contentions. The evidence of record shows that the applicant
acknowledged receiving the required pregnancy counseling by her unit
commander and understood her entitlements and responsibilities. The
applicant was given seven (7) days to elect to remain on active duty or
request voluntary separation. The evidence further shows that the
applicant elected separation by reason of pregnancy. She submitted a DA
Form 4187 (Personnel Action) requesting voluntary separation under the
provisions of Chapter 8, AR 635-200, by reason of pregnancy. The unit and
intermediate commander recommended approval of the applicant’s request and
the separation authority approved the discharge action. The Board found no
evidence of arbitrary or capricious action on the part of the applicant’s
chain of command. The Board, being convinced that the reason for discharge
was both proper and equitable, voted not to change it.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
equity to change the discharge. The major factors upon
which the discharge was based are set forth in Parts III
and IV of this decisional document.
