      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable
requirements for clarity and responsiveness.  You may obtain a copy of DoD

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 20 March 1990, the applicant
voluntarily requested separation under the provisions of Chapter 8, AR 635-
200 by reason of pregnancy.  On 17 April 1990, the separating authority
approved the applicant’s voluntary request for separation and directed that
she be transferred to the Individual Ready Reserve.  The record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty), which was authenticated by the applicant’s signature.  Her DD
Form 214 indicates that she was released from active duty under the
provisions of Chapter 8, AR 635-200 by reason of pregnancy, with a
characterization of service of honorable.

      b.  On 27 April 1990, the applicant was released from active duty and
transferred to the USAR Control Group.  At the time of her release from
active duty, the applicant had completed 2 years, 5 months, and 4 days of
active military service in the period under review.  On 10 August 1995, the
applicant was honorably discharged from the Army Reserve upon completion of
her statutory service obligation.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 8 establishes policy and procedures for voluntary separation of
enlisted women because of pregnancy.  If an individual is beyond entry-
level status, her service will be characterized as honorable or general,
under honorable conditions.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The evidence of record shows that the applicant voluntarily requested
release from active duty under the provisions of Chapter 8, AR 635-200, by
reason of pregnancy.  In order to have been eligible for a hardship
discharge the applicant would have been required to meet the criteria
established under the provisions Chapter 6, AR 635-200, and there is no
evidence that she pursued a discharge conditioned on a hardship.  This
Board does not change a discharge solely to gain access to veteran’s
benefits.  The Department of Veterans Affairs (DVA) administers veteran’s
benefits in accordance with its own policies and regulations.  The
applicant must address questions concerning her entitlement to educational
benefits to the DVA.  There is no evidence of arbitrary or capricious
actions by the command.  The Board was satisfied that all requirements of
law and regulation were met and the rights of the applicant were fully
protected throughout the separation process.  The Board, being convinced
that the reason for the applicant’s release from active duty was both
proper and equitable, voted to deny relief.
