PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  Evidence of record shows that on 19 November 2001, DA, HQ, 101st Airborne Division (Air Assault) and Fort Campbell, Kentucky, Orders 323-0021 released the applicant from active duty effective 31 December 2001.  The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty).  Her DD Form 214 indicates that she was released from active duty and transferred to the USAR Control Group under the provisions of Chapter 8, AR 635-200 by reason of pregnancy or childbirth, with a characterization of service of general, under honorable conditions.  The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.  

	b.  On 31 December 2001, the applicant was released from active duty.  At the time of release, the applicant had completed 3 years, 6 months, and 20 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter 8, in pertinent part, establishes policy and procedures for voluntary releases and separations because of pregnancy.  Separation processing may not be initiated until the individual has been adequately counseled using the pregnancy counseling checklist.  An individual being released or discharged under this chapter will be awarded a character of service of honorable, under honorable conditions or an uncharacterized description of service if in entry-level status.

	a.  Propriety:	The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

        (1)  The issue is rejected.  The applicant’s record is void of facts and circumstances concerning events that led to her release from active duty.  The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty).  The evidence shows that the applicant was released from active duty under the provisions of Chapter 8, AR 635-200, by reason of “pregnancy or childbirth,” with a general, under honorable conditions characterization of service.  Procedurally,.  releases or discharges under the provisions of Chapter 8, AR 635-200, are processed solely on a voluntary basis, therefore, the applicant was required to submit a voluntary request for release from active duty.  In the absence of evidence to the contrary, the Board presumed administrative regularity in the applicant’s release from active duty.  The Board, being convinced that the reason for the release action and the characterization of service were both proper and equitable, voted to deny relief.
