SECTION A-ANALYSTS ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 19 November 2001, DA, HQ, 101st Airborne Division (Air Assault) and Fort Campbell, Kentucky, Orders 323-0021 released the applicant from active duty effective 31 December 2001. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). Her DD Form 214 indicates that she was released from active duty and transferred to the USAR Control Group under the provisions of Chapter 8, AR 635-200 by reason of pregnancy or childbirth, with a characterization of service of general, under honorable conditions. The specific facts and circumstances pertaining to the applicants discharge are not contained in the available records.
b. On 31 December 2001, the applicant was released from active duty. At the time of release, the applicant had completed 3 years, 6 months, and 20 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. (1) The issue is rejected. The applicants record is void of facts and circumstances concerning events that led to her release from active duty. The Board noted that the applicants record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). The evidence shows that the applicant was released from active duty under the provisions of Chapter 8, AR 635-200, by reason of pregnancy or childbirth, with a general, under honorable conditions characterization of service. Procedurally,. releases or discharges under the provisions of Chapter 8, AR 635-200, are processed solely on a voluntary basis, therefore, the applicant was required to submit a voluntary request for release from active duty. In the absence of evidence to the contrary, the Board presumed administrative regularity in the applicants release from active duty. The Board, being convinced that the reason for the release action and the characterization of service were both proper and equitable, voted to deny relief.
