SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances leading to the applicant’s
discharge are not contained in the available records. Evidence of record
shows that on 12 December 1996, Orders 347-0209, DA, Headquarters, III
Corps, Fort Hood, TX, amended by 1st Endorsement, 18 December 1996, and
Orders 354-0255, 19 December 1996, released the applicant from the Regular
Army, effective 20 December 1996, and transferred her to her inactive
training unit at Fort Lee, VA. The record contains a properly constituted
DD form 214 (Certificate of Release or Discharge from Active Duty), which
was authenticated by the applicant’s signature. Her DD Form 214 indicates
that she released from active duty under the provisions of Chapter 8, AR
635-200, by reason of pregnancy, with uncharacterized service.
Furthermore, the DD Form 214 shows a Separation Code of MDF (i.e.,
pregnancy or childbirth), with a reentry code of 3.
b. On 20 December 1996, the applicant was released from active duty.
At the time of release, the applicant had completed 2 month and 13 days of
active military service in the period under review and had a total of 3
years, 1 month, and 18 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 8 establishes policy and procedures for voluntary separation of
enlisted women because of pregnancy. If an individual is beyond entry-
level status, her service will be characterized as honorable or general,
under honorable conditions.

a. Propriety: The parenthetical number(s) below correspond(s) to
the issue number(s) on the DD Form 293, or in Part VI,
Paragraph 1, above.
(1) The issue is rejected. The evidence of record shows that the
applicant reenlisted in the Regular Army after a break in active military
service that exceeded 92 days. Additionally, at the time of the
applicant’s release from active duty the applicant had served less than 180
days of continuous active duty service. Accordingly, the applicant was in
entry-level status at the time she was released from active duty. Army
Regulation 635-200 also provides, except in cases of serious misconduct,
that a soldier’s service will be uncharacterized when separation is
initiated while the soldier is in entry-level status. The applicant’s
record is void of the specific facts and circumstances concerning the
events that led to her release from active duty. However, the applicant’s
record contains a properly constituted DD Form 214 (Certificate of Release
or Discharge from Active Duty), which was authenticated by the applicant’s
signature. This document identifies the reason and characterization of
service granted and the Board presumed Government regularity in her release
from active duty. The applicant’s DD Form 214 shows that the applicant,
while in an entry-level status, was released from active duty under the
provisions of Chapter 8, AR 635-200, by reason of pregnancy with service
uncharacterized. In the absence of evidence to the contrary, the Board was
satisfied that all requirements of law and regulation were met and the
rights of the applicant were fully protected throughout the separation
process. The Board noted the applicant’s contentions; however, did not
find said contentions sufficiently mitigating to warrant an upgrade of the
discharge under review. The Board, being convinced that the reason for
separation and the characterization of service were both proper and
equitable, voted to deny relief.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
equity to change the discharge. The major factors upon
which the discharge was based are set forth in Parts III
and IV of this decisional document.
