PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 20 October 1994, the applicant
acknowledged that she received the required pregnancy counseling by the
unit commander and understood her entitlements and responsibilities. The
applicant was given seven (7) days to elect to remain on active duty or
request voluntary separation. On 27 October 1994, she elected separation
for reason of pregnancy. On 9 November 1994, she submitted her request for
voluntary separation under the provisions of Chapter 8, AR 635-200, by
reason of pregnancy. On 30 November 1994, the unit commander recommended
approval of the applicant’s request. On 1 December 1994, the separation
authority approved the discharge action with an entry-level discharge.
b. On 9 December 1994, the applicant was discharged. At the time of
discharge, the applicant had completed 6 months and 28 days of active
military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 8 establishes policy and procedures for voluntary separation of
enlisted women because of pregnancy. If the soldier is still in Entry-
Level Status, her service will be described as uncharacterized. Entry-
Level Status is defined as for Regular Army soldiers, the first 180 days of
continuous AD. If a soldier is beyond Entry-Level Status, her service will
be characterized as honorable or general, under honorable conditions.

(2) The issue is accepted. The evidence of record shows that the
applicant voluntarily requested discharge from the Army under the
provisions of Chapter 8, AR 635-200, by reason of pregnancy. The evidence
also shows that at the time of the applicant’s request the applicant was no
longer in an entry-level status. Therefore, in accordance with Chapter 8,
Paragraph 8-3, AR 635-200, the applicant’s service required a
characterization of service of either honorable or general, under honorable
conditions. In view of the foregoing the Board determined that the
characterization of service is improper. Finding no justification in the
applicant’s record for issuance of a general, under honorable conditions
characterization of service the Board voted to grant full relief in the
form of a change to the characterization of service to fully honorable.
The Board was satisfied that the reason for discharge was both proper and
equitable, and voted not to change it.
