PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. On 18 June 1998 Department of the Army, Headquarters, 10 th Mountain Division (Light Infantry) and Fort Drum, Fort Drum, New York Orders 169-1004 reassigned the applicant to the United States Army transition point for transition processing. The applicant’s record is void of the specific facts and circumstances concerning events that led to her discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was not authenticated by the applicant due to her unavailability to sign. This document identifies the reason and characterization of the discharge as Chapter 8, AR 635-200, for pregnancy, with an honorable discharge.

         b. On 8 July 1998, the applicant was discharged. At the time of discharge, the applicant had 1 year, 10 months, and 18 days service on her current enlistment.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200, Chapter 8-1, provides the basic authority for the separation of enlisted personnel. This Chapter established policy procedures, and provides authority for voluntarily separation of enlisted women because of pregnancy. This Chapter applies to all Active Army enlisted women and ARNGUS and USAR enlisted women ordered to AD or ADT, except for ARNGUS and USAR soldiers found to be pregnant upon entry on IADT, to whom paragraph 5-11 applies.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant was discharged under the provisions of Chapter 6, AR 635-200 for an inability to perform prescribed duties due to pregnancy. This voluntary separation was appropriate since the command determined that the applicant’s parental obligations interfered with the fulfillment of military responsibilities. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Accordingly, the Board determined that the reason for discharge was both proper and equitable and voted not to change.
