                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  Evidence
of record shows that on 31 July 1993, DA, HQ, 77th United States Army
Reserve Command, Fort Totten, Flushing, New York, Orders 127-11, discharged
the applicant from the United States Army Reserve, effective date 31 July
1993, with a characterization of service of under other than honorable
conditions discharge.

      b.  On 31 July 1993, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 year, 3 months, and 9 days of
total military service.

      c.  The applicant’s OMPF does not contain any information used as the
basis for his discharge.  However, in the applicant’s statement
accompanying his DD Form 293 (Application for the Review of Discharge), he
states that he “made a bad judgment call and smoked marijuana, which
resulted in me testing positive and getting the discharge that I
received….”

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

2.  Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on
issues of propriety and/or equity:

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
available records for the period of enlistment under review.
Notwithstanding that the available record is void of the specific facts and
circumstances concerning the events that led to the applicant’s discharge
from the Reserve of the Army; the Board determined that the
characterization of service is inequitable.  The Board believed the
applicant’s statement as to the reason for his discharge and found that his
misconduct was mitigated by service of sufficient merit to warrant an
upgrade of the discharge being reviewed.  Accordingly, the Board voted to
grant partial relief in the form of an upgrade of characterization of
service to general, under honorable conditions.  The Board determined that
the reason for discharge was both proper and equitable and voted not to
change it.  This action entails a restoration of the applicant’s grade to
E4.

        (1)  The issue is rejected.  The applicant, by his admitted
misconduct, diminished the quality of his service below that meriting a
fully honorable discharge.  See response to issue (2) above.
