PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 26 September 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 7, AR 135-178 by reason misconduct – abuse of illegal drugs, with an under other than honorable conditions discharge. She was advised of her rights. On 18 July 1995, MAJ, JA, USAR notified the applicant that she was to appear before a board of officers on 5 August 1995. MSC recommended approval of a general, under honorable conditions discharge and forwarded it through command channels to the separation authority. Staff Judge Adjutant concurred. On 17 June 1997, the separation authority approved that the applicant be discharged with a general discharge.

         b. On 25 July 1997, the applicant was discharged. She was credited with
7 years, 7 months, and 4 days active service on the enlistment under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 135-178 (Separation of Enlisted Personnel) provides for the separation of enlisted personnel of the Army Reserve and Army National Guard. Paragraph 7-11 of the regulation, in effect at the time, governed separation for acts or patterns of misconduct, including abuse of illegal drugs.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted the applicant’s contention that her discharge was inequitable and based on an isolated incident with no other adverse action. Although a single incident, the Board concluded that the discrediting entry constituted a departure from the standards of conduct expected of soldiers in the Army. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in a soldier. The applicant, as a soldier, had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
