                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the facts and circumstances leading to the applicant’s
discharge are not in the available records.  Evidence of record shows that
on 20 June 2000, the applicant was involuntarily released from his USAR
assigned unit in Lewiston, ME and reassigned to the USAR Control Group,
Individual Ready Reserve-Annual Training (AT), St Louis, MO, by reason of
unsatisfactory participation.  On 7 August 2001, DA, United States Army
Reserve Personnel Command, St Louis, Missouri, Orders D-08-137157
discharged the applicant from the United States Army Reserve, with a
characterization of service of honorable.  He was discharged effective 7
August 2001, which was prior to the expiration of his enlistment
obligation.

      b.  On 7 August 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 5 months, and 18 days of
military service in the period under review and had a total of 8 years and
2 days of total military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

issues of propriety and/or equity:

      a.  Propriety:   The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The applicant’s record is void of the
specific facts and circumstances concerning the events that led to a
discharge from the Reserve of the Army.  However, the applicant’s record
contains a properly constituted order issued by Department of the Army,
U.S. Army Reserve Personnel Command discharging the applicant from the
United States Army Reserve, effective 7 August 2001, by authority of AR 135-
178 with a characterization of service of honorable.  The specific reason
for discharging the applicant prior to the completion of his required term
of service is not a matter of record.  Barring evidence to the contrary the
Board presumed Government regularity in the discharge process.  The Board
was satisfied that all requirements of law and regulation were met and the
rights of the applicant were fully protected throughout the separation
process.  The Board noted the applicant’s contentions; however, did not
find said contentions sufficiently mitigating to warrant a change to the
discharge under review.  Further, changing the context of the order
transferring the applicant to the Individual Ready Reserve-Annual Training
does not fall within the purview of this Board.  The Board, being convinced
that the authority for discharge and the characterization of service were
both proper and equitable, voted to deny relief.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
                   equity to change the discharge.  The major factors upon
                   which the discharge was based are set forth in Parts III
                   and IV of this decisional document.
