PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 7 October 1997 the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure. On 4 December 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of drug rehabilitation failure, with an honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service. On 15 December 1997, the separation authority directed that the applicant be discharged with a characterization of service of honorable conditions.

         b. On 9 January 1998, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 7 months, and 1 day of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to ADAPCP for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the applicant was separated under the provisions of AR 635-200, Chapter 9, by reason of drug rehabilitation failure, with an honorable discharge. The applicant was enrolled in the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) in July 1996 and was aware of the consequences of any action which would demonstrate any inability or refusal to participate in, cooperate in, or successfully complete such a program. While enrolled in the program he tested positive for cocaine use on three occasions. As a result of the applicant’s actions and after consultation with the drug and alcohol abuse counselor, the command declared the soldier a rehabilitation failure. The evidence of record establishes the fact that the applicant was properly counseled and afforded a reasonable opportunity to overcome his problems. The Board congratulates the applicant on his educational achievements since he left the Army. However, the Board found that this accomplishment did not overcome the reason for discharge. The Board noted that the applicant was reduced in grade because he accepted nonjudicial punishment for illegal use of cocaine. His reduction to private/E-2 was originally suspended; however, he illegally used cocaine again during the period of suspension and the suspension was vacated and the reduction in grade took effect. If the applicant still believes he is entitled to restoration of grade, the issue should be addressed to the Army Board for Correction of Military Records (ABCMR). An application to the ABCMR is enclosed. The Board being convinced that the reason for discharge was both proper and equitable, voted to deny relief.
