SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty).  His DD Form 214 indicates that he was discharged under the provisions of Chapter 11, AR 635-200 by reason of entry-level performance and conduct, with a characterization of service of uncharacterized.  The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.  

	b.  On 12 June 2002, the applicant was discharged.  At the time of discharge, the applicant had completed 2 months, and 4 days of active military service, and had a total of 1 year, 3 months, and 20 days total military service.

	c.  The applicant’s record shows that he initially enlisted in the US Army Reserve on 22 February 2001 and attended BCT and AIT at Fort Leonard Wood, Missouri, on 9 March 2001 and on 14 May 2001, respectively.  He successfully completed AIT in military occupational specialty 88M.  He was promoted to the grade of private first class/E-3 prior to enlisting in the Regular Army on 9 April 2002.  

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status.  This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service.  The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline.  The regulation requires uncharacterized service for separation under this chapter.

	a.  Propriety:	The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

        (1)  The issue is rejected.  The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army.  The Board noted that the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty).  This document shows that the applicant was separated under the provisions of Chapter 11, AR 635-200, while in entry-level status with an uncharacterized discharge.  In the absence of evidence to the contrary, the Board presumed regularity in the discharge process.  This type of discharge simply means that the soldier was in an entry-level status, i.e., in an initial probationary period of service.  Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge.  This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty.  A fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty.  The Board determined that no such unusual circumstances were present in the applicant’s record and his service did not warrant an honorable discharge.  The applicant’s issues regarding reassignment to a Army Reserve unit, RE code and reenlistment are not within the purview of this Board.  These matters should be addressed by the Army Board for Correction of Military Records (ABCMR).  A
DD Form 149 (i.e., application to the ABCMR) is included for the applicant’s use.    The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
