PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 1 June 1993 Psychiatric evaluation resulted in the applicant being diagnosed with a personality disorder not otherwise specified, it further recommended that the applicant be separated under the provisions of chapter 5, AR 635-200. On 2 June 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200 by reason of personality disorder, and that he was recommending an uncharacterized discharge. The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, waived a hearing by a board of officers and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval. On 10 June 1993, the separation authority directed that the applicant be discharged with an uncharacterized description of service because he was still in an entry level status.

         b. On 15 June 1993, the applicant was discharged with an uncharacterized discharge. At the time of his discharge the applicant had completed 2 months, and 29 days of active military service.

         c. The applicant’s record shows that he was diagnosed with a personality disorder while still in an entry level status (ELS). Soldiers separating under the provisions of paragraph 5-13 by reason of personality disorder who are in an ELS are provided an uncharacterized description of service. This is not an adverse separation action and denotes only that the individual had less than
l80 days on active duty and was still in his probationary period of service at the time discharge action was initiated.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases unless the soldier in an entry level status in which case he will be given an uncharacterized description of service.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention that he would like his uncharacterized description of service upgraded to an honorable discharge. However, this factor does not provide the board a basis on which to upgrade the discharge. The Board noted that the applicant was separated with an uncharacterized discharge. This type of discharge simply means that the soldier was in an entry level status, which is a initial probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. The Board, being convinced that the characterization of service and the reason for discharge were proper and equitable, voted to deny relief.
