PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 19 November 2001, DA, HQ, 101 st Airborne Division (Air Assault) and Fort Campbell, Fort Campbell, KY, Orders 323-0021, released the applicant from the active duty and reassigned her to the USAR Control Group, effective 31 December 2001. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). Her DD Form 214 indicates that she was released from active duty under the provisions of Chapter 8, AR 635-200 by reason of pregnancy or childbirth with service characterized as general, under honorable conditions. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.

         b. On 31 December 2001, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 6 months, and 20 days of active military in the period under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 8 establishes policy and procedures for voluntary separation of enlisted women because of pregnancy. If an individual is beyond entry-level status, her service will be characterized as honorable or general, under honorable conditions.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The Board carefully examined the available record of service during the period of enlistment under review. Although the Board noted that the specific facts and circumstances leading to the applicant’s release from duty are not available, the Board noted that the applicant served 3 years and 6 months of her 4-year enlistment, that she attained the rank of E-4, and earned an Army Good Conduct Medal. The Board also noted that the applicant was released from active duty and transferred to the USAR Control Group for completion of her statutory service obligation without a reduction in grade. Based on the above factors, the Board found that the characterization of service was too harsh. Accordingly, the Board voted to voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was both proper and equitable and voted not to change it.
