PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  Evidence of record shows that on 13 September 1999, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure.  On 30 September 1999, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of alcohol abuse rehabilitation failure, with an honorable discharge.  He was advised of his rights.  The applicant consulted with legal counsel, was advised of the impact of the discharge action, waived consideration of his case by an administrative separation board and did not submit a statement in his own behalf.  The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts.  The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge.  On 1 December 1999, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of honorable.  

	b.  On 17 December 1999, the applicant was discharged.  At the time of discharge, the applicant had completed 2 years, 6 months, and 19 days of active military service in the period under review and had a total of 6 years, 3 months and 10 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse.  A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical.  Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service.  (However, an honorable discharge is required if restricted use information is used in the discharge process).

	a.  Propriety:	The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

	b.  Equity:	The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony.  The evidence of record shows that the applicant was counseled on several occasions before separation action was initiated.  The unit commander in consultation with the Clinical Director/ADAPCP declared the applicant an alcohol rehabilitation failure due to his refusal to participate in a substance abuse treatment program.  The appropriate authority approved the applicant's discharge with issuance of an honorable discharge.  The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.  Furthermore, changes to reentry eligibility (RE) codes does not fall within the purview of this Board.  However, the evidence of record shows that the applicant was properly assigned a RE code of “4.”  RE-4 indicates that the applicant was discharged with a non-waivable disqualification and is barred from reenlistment.  If the applicant still believes there is an error or injustice in the discharge, he then may make application to the Army Board for Correction of Military Records, utilizing a DD Form 149, which is included with this response.  The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
