PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

 a. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge as uncharacterized under the provisions of Chapter 11, AR 635-200, entry-level performance and conduct with an SPD Code of JGA.

         b. On 31 August 1998, the applicant was discharged. At the time of discharge, the applicant had 1 month, and 22 days service on his current enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

 (1) The issue is rejected. The Board carefully examined the available evidence of record during the period of enlistment under review. The specific facts and circumstances leading to the applicant’s discharge from service are not contained within the record. However, the record does contain a properly constituted DD Form 214 which was authenticated by the applicant. This document shows that the applicant was discharged under the provisions of Chapter 11, AR 635-200, for entry level performance and conduct. This type of discharge simply means that the soldier was in an entry-level status, i.e., in an initial probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. In accordance with AR 635-5, “JGA” is the appropriate Separation Program Designator (SPD) Code assigned for an entry level performance and conduct separation. The applicant’s corresponding RE code of 3 is also appropriate. An RE code of 3 indicates that the applicant requires a waiver prior to being allowed to reenlist. If the applicant desires to reenlist, he should contact the local recruiter to determine his eligibility to reenlist. Those individuals are required to process waivers of reentry eligibility (RE) codes. The Board being convinced that the reason for discharge was both proper and equitable, voted not to change it.
