PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 25 February 1999, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200, failure adapt to the military environment, with an uncharacterized discharge. The applicant was advised of her rights, declined legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in her own behalf. On 2 March 1999, the separation authority directed that the applicant be discharged with an uncharacterized discharge.

         b. On 8 March 1999, the applicant was discharged with an uncharacterized discharge, under the provisions of Chapter 11, AR 635-200, by reason of entry level performance and conduct. At the time of discharge the applicant had completed 1 month and 5 days of active military service.

         c. The applicant’s record shows that she completed just over 1 months of active duty. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. The evidence of record shows the applicant was processed for separation because her family difficulties were impacting her ability to concentrate during basic training. The applicant was in an entry level status at the time she was separated which dictated the uncharacterized description of her service. The applicant, even if she had been discharged by reason of hardship discharge, would still have received an uncharacterized discharge. Chapter 6, AR 635-200, which provides the policy and procedure for separating enlisted personnel by reason of hardship discharge, dictates that an uncharacterized description of service be given to soldiers who are in an entry level status. Entry level status is an initial probationary period of service and applies to any soldier who has not completed over 180 days of active duty at the time their separation action is initiated.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, she should have received a hardship discharge and was lied to by her commander regarding his receipt of supporting documentation verifying the serious illness of her son. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board found no evidence of arbitrary or capricious actions by the command; in addition, as part of the separation process, the applicant acknowledged the reason for her discharge and provided no statement of rebuttal in her own behalf. While the Board appreciates the medical problems experienced by the applicant’s family members, this factor alone does not provide a basis for relief. The evidence of record shows that the applicant was in an entry level status at the time of her separation. This type of discharge simply means that a soldier was in an initial probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. The Board, being convinced that the characterization of service and the reason for discharge were both proper and equitable, voted to deny relief.
