PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The applicant was released from active duty, under the provisions of Chapter 16, AR 635-200, by reason of reserve component personnel completion of military occupational specialty(MOS) training. The available record also contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents that the applicant was released from active duty with an uncharacterized description of service.

         b. On 28 October 1983, the applicant was discharged with an uncharacterized discharge, under the provisions of Chapter 16, AR 635-200, by reason of reserve component personnel upon completion of MOS TNG or early release of RCP. At the time of his release from active duty the applicant had completed 3 months and
24 days of active duty.

         c. The applicant’s record shows that he was released from his IADT period upon completion of his MOS training. The applicant had completed just 3 months and 24 days of active duty which placed him in an entry level status at the time of his separation. The record also contains a properly constituted DD Form 214 which was authenticated by the applicant and documents that he received an uncharacterized description of service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Paragraph 16-9, in effect at the time, prescribed the policy and procedure for the early release from active duty of reserve component personnel, serving on their initial active duty for training (IADT), upon completion of their MOS training. Army policy states that the service of personnel separated under this paragraph will be characterized as honorable unless an entry level separation in which case an uncharacterized description of service would be awarded.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention that he completed his obligation and should have received an honorable discharge. However, the Board determined that the applicant was properly separated, under the provisions of Paragraph 16-9, AR 635-200, prior to the end of his term of service as outlined in his active duty order. This regulatory guidance allowed for the early separation of reserve component personnel upon their completing their MOS training. Further, the Board noted that the applicant was separated with an uncharacterized description of service. This type of separation simply means that the soldier was in an entry level status, an initial probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized separation. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. The Board, being convinced that the characterization of service and the reason for discharge were proper and equitable, voted to deny relief.
