PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that the unit commander notified the applicant of initiation of separation action under the provisions of
Chapter 11, AR 635-200, with an uncharacterized discharge. He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended approval with an uncharacterized discharge and forwarded it through command channels to the separation authority. On 13 July 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be transferred to the Individual Ready Reserve with an uncharacterized discharge.

         b. On 28 July 1992, the applicant was discharged. He was credited with
7 months, and 29 days active service on the enlistment under review.

         c. The unit commander recommended the applicant be separated from the service because he failed to successfully complete the Special Forces Assessment and Selection Course.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

 (1) The issue is rejected. The Board carefully considered the applicant’s additional documents and his record of service during the period of enlistment under review. The Board noted that the applicant was separated with an uncharacterized discharge as a result of his failing to satisfactorily complete the Special Forces Qualification Course. This type of discharge simply means that the soldier was in an entry-level status, i.e., in an initial probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. Army Regulation 635-200, page 82, Section II of the Glossary states if there is a break in service of more than 92 days for a Regular Army soldier between enlistment periods the soldier will be considered to be in an entry-level status for the first 180 days of that enlistment. The Board, being convinced that the characterization of service and the reason for discharge were both proper and equitable, voted to deny relief.
