PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 23 November 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l1, AR 635-200, by reason of entry level performance and conduct. The applicant was advised of her rights, the impact of the discharge action, and she submitted a statement in her own behalf. On 28 October 1997, the separation authority directed that the applicant be discharged with a an uncharacterized description of service.

         b. On 30 November 1998 the applicant was discharge with an uncharacterized description of service after completing 2 months and 21 days of active military service.

         c. The applicant’s record reflects that she completed only 2 months and
21 days of service and that the highest rank she attained while on active duty was private/E-1. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. The unit commander processed the applicant for separation by reason of entry level performance and conduct, citing the applicant’s failure to adapt to the military environment as the basis for taking the action. The available record also includes properly constituted DD Form 214 which was signed by the applicant and documents the reason for separation and that she received an uncharacterized description of service, while in an entry level status.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1), (2), and (3) The issues are rejected. The Board noted the applicant’s contentions, as outlined in the request for discharge review enclosed with her application, that, in effect, her discharge was improper because there was no offense committed; that there was no reason for her to be held behind; and that her and her three friends were singled out. All the specific facts and circumstances concerning the events which led to the applicant’s discharge are not contained in the available records. However, after carefully examining all the available records of the applicant’s service for the period of enlistment under review, the Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board noted from the evidence of record that the applicant received an uncharacterized separation while in an entry level status (ELS). The separation authority approved the applicant's discharge as entry level status, with the description of service as uncharacterized. A soldier is in entry level status for the first 180 days of continuous active duty. The purpose of the entry level status is to provide the soldier a probationary period. Soldiers who are found to lack the necessary motivation, adaptability, self-discipline, ability, or attitude to become productive soldiers may be expeditiously separated while in entry level status. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

(4) and (5) The issues are rejected. The Board noted the applicant’s contentions, outlined in her request for discharge review enclosed with her application, that a correction to her military records should be made to show administrative error; and that she should be reinstated and receive back pay from the date of her discharge. However, these issues are not within the purview of the Army Discharge Review Board (ADRB). The ADRB is not empowered to return former service members to active duty or to grant back pay. The Board may only change the characterization or reason for discharge. If the applicant still believes there is an error or injustice in their discharge, the proper venue for consideration of these issues, is the Army Board for Correction of Military Records (ABCMR). The applicant may apply to the ABCMR for the correction of her military records by utilizing the DD Form l49 enclosed with this document.
