PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. Note: The evidence of record shows that on 11 June 1998, Orders 162-00257, DA, US Army Chemical and Military Police Centers and Fort McClellan, AL, discharged applicant from the Regular Army, effective date: 15 June 1998. Applicant signed DD Form 214, indicating following facts: Character of service is an uncharacterized discharge under the provisions of Chapter 7, AR 635-200, fraudulent entry.

         b. On 15 June 1998, the applicant was discharged with an uncharacterized discharge, under the provisions of Chapter 7, AR 635-200, by reason of fraudulent entry. He was credited with 19 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 7, paragraph 7-17, of that regulation provides, in pertinent part, that a fraudulent entry is the procurement of an enlistment, reenlistment, or period of active service through any deliberate material misrepresentation, omission, or concealment of information which, if known and considered by the Army at the time of enlistment or reenlistment, might have resulted in rejection. This includes all disqualifying information requiring a waiver. A soldier who concealed his or her conviction by civil court of a felonious offense normally will not be considered for retention. Soldiers separated under this chapter may be awarded an honorable discharge, or a general discharge, or a discharge under other than honorable conditions. If in an entry level status the characterization will be uncharacterized.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The applicant's record is void of facts and circumstances concerning the events that led to his discharge from the Army. However, the Board noted that the applicant's record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This identifies the reason and characterization of discharge and the Board presumed government regularity in the preparation of the document. The applicant has provided no independent corroborating evidence to overcome the Board's presumption of regularity. Contrary to the applicant's contention, he did not receive a general discharge. His DD Form 214 confirms that he received an uncharacterized description of service. Soldiers separated within the first 180 days of active duty are considered to be in an entry-level status and thus receive an uncharacterized description of service. Accordingly, the Board found that the reason for discharge and the characterization of service were both proper and equitable, and voted to deny relief.
