PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that the applicant signed his DD Form 214 (Certificate of Release or Discharge from Active Duty). The DD Form 214 indicates that he was discharged under the provisions of Chapter 4, AR 635-200, with a characterization of service of uncharacterized. Furthermore, the DD Form 214 shows a Separation Code of LBK. The specific facts and circumstances leading to the applicant’s discharge indicate that he sustained a stress fracture to his left ankle and was released from ADT.

         b. On 18 December 1989, the applicant was discharged with an uncharacterized discharge, under the provisions of Chapter 4, AR 635-200. He was credited with 4 months, and 18 days active service on the enlistment under review.

2.
Legal/Regulatory Basis for Separation Action : Army Regulation 635-200, in effect at the time, set forth the basic authority for separation of enlisted personnel. ARNGUS and USAR soldiers who successfully complete a period of IADT to which ordered, will out-process per AR 612-201. The service of soldiers specified in this paragraph who are in entry level status will be uncharacterized, even though they have completed their IADT successfully.

( )     Revised issue(s) furnished in writing by applicant as follows:
         ( )     Additional issue(s) identified during review/hearing as follows:

         b. Request: ( X ) Recharacterization ( ) Change of Reason

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted from the evidence of record that the applicant received an uncharacterized separation under the provisions of AR 635-200 while in an entry level status (ELS). The applicant was separated from IADT prior to the completion of his required training due to a stress fracture. The separation authority approved the applicant's discharge as entry level status, with the description of service as uncharacterized. A soldier is in entry level status for the first 180 days of continuous active duty. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. The Board, being convinced that the characterization of service and the reason for discharge were both proper and equitable, voted to deny relief.

3. Response(s) to item(s) not addressed as decisional issue(s): NONE
