PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 26 September 1985, the unit commander in consultation with the Clinical Director of the Army Drug and Alcohol Prevention Control Program (ADAPCP) declared the applicant a rehabilitation failure. On 20 December 1985, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200 by reason for drug abuse rehabilitation failure, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The separation authority directed that the applicant be discharged with a GD.

         b. On 24 January 1986, the applicant was discharged with a GD. At the time of his discharge the applicant had completed 2 years, 8 months, and 13 days active service.

         c. The applicant’s record shows that he completed almost 3 years of service and attained the rank of specialist/E-4. The applicant’s disciplinary history includes his acceptance of an Article 15 on 25 October 1985, for the wrongful use of marijuana which resulted in his reduction in rank to private first class/E-3. The applicant self referred himself to ADAPCP in September 1984; on 29 August 1985, he took a command directed urinalysis as a result of being drunk and disorderly which came back positive for THC; and on 17 September 1985, he again tested positive for THC. Based on the theses incidents and in consultation with ADAPCP personnel, the unit commander declared the applicant an ADAPCP rehabilitation failure and processed him for separation, under the provisions of Chapter 9, AR 600-85.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

(8) The issue is accepted. The Board noted that the government introduced a document into the discharge process revealing that the applicant had self-referred to the Alcohol and Drug Prevention and Control Program for substance abuse. This is limited use information as defined in Chapter 6,
AR 600-85. Use of this information mandates award of a fully honorable discharge. Accordingly, the Board voted to change the characterization of service to fully honorable. However, the board found that the reason for discharge was fully supported by the record and voted not to change it.
