PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 25 September 1985, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure. On 11 October 1985, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200 by reason of alcohol abuse-rehabilitation failure, with a general, under honorable conditions discharge. He was advised of his rights. The applicant acknowledged notification, declined legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended approval of a general discharge and forwarded it through command channels to the separation authority. On 11 October 1985, the separation authority directed that the applicant be discharged with a general discharge.

         b. On 1 November 1985, the applicant was discharged. He was credited with
1 year, 5 months, and 29 days active service on the enlistment under review.

         c. The unit commander recommended the applicant be separated due to his inability to achieve the standards of conduct expected of a soldier in the United Army. The commander further noted that the applicant’s abuse of alcohol has resulted in poor duty performance and he has continued to abuse alcohol.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

(5) The issue is accepted. The Board noted that the government introduced a document into the discharge process revealing that the applicant had self-referred to the Alcohol and Drug Prevention and Control Program for substance abuse. This is limited use information as defined in Chapter 6, AR 600-85. Use of this information mandates award of a fully honorable discharge. Accordingly, the Board voted to change the characterization of service to fully honorable. However, the board found that the reason for discharge was fully supported by the record and voted not to change it.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

The Board noted that the applicant was enrolled in the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) and was aware of the consequences of any action that would demonstrate any inability or refusal to participate in, cooperate in, or successfully complete such a program. As a result of the applicant’s actions and after consultation with the drug and alcohol abuse counselor, the command declared the soldier a rehabilitation failure. The Board found no evidence of arbitrary or capricious actions by the command. See response to issue (5) above.

The Army Discharge Review Board cannot change the applicant’s reentry eligibility (also known as the reenlistment) (RE) code. To obtain a change in an RE code, the applicant should provide supporting documentation to justify any change and submit the request to the Commander, US Army PERSCOM, ATTN: TAPC-EPR-P, 2461 Eisenhower Avenue, Alexandria, Virginia 22331-0450. To obtain a waiver for reenlistment, the applicant should contact a local Army recruiter for assistance.
