PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 26 September 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200, inability to adapt to a military environment, with a recommendation for an uncharacterized discharge. The applicant was advised of her rights, declined legal counsel, was advised of the impact of the discharge action, waived a hearing by a board of officers, and elected not to submit a statement in her own behalf. On 3 October 1994, the separation authority directed that the applicant be discharged with an uncharacterized discharge.

         b. On 5 October 1994, the applicant was discharged with an uncharacterized discharge. At the time of separation the applicant had completed 4 months and
9 days of continuous active service on the enlistment under review.

         c. The applicant’s record indicates that she had completed less than 180 days of continuous active duty, after a break in service of over 92 days, on the enlistment under review. The unit commander initiated an entry level status separation action on the applicant, indicating that the applicant lacked motivation and self-discipline. The unit commander cited the following in support of his action: the applicant’s many personal problems which affected her ability to adapt; her many counseling statements for performance deficiencies; and for attitude problems. The applicant was afforded all rights associated with the action and elected to decline counsel, not to submit a statement in her own behalf, and waive consideration of her case by a board of officers. There is no indication in the record that the applicant contested the action at the time.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, her discharge should be upgraded because she suffered from medical problems which were misdiagnosed which accounted for her problems and that she had prior honorable service. However, after carefully examining the applicant’s record of service for the period of service under review, the Board determined the applicant’s discharge was appropriate. The applicant was separated with an uncharacterized discharge while in an entry level status. This type of discharge simply means that the soldier was in a probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty, after a break in service of over 92 days. A fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and her service did not warrant an honorable discharge. The Board, being convinced that the characterization of service and the reason for discharge were both proper and equitable, voted to deny relief.
