PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 2 April 1987, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200 entry level status performance and conduct, with an uncharacterized discharge. The applicant was advised of her rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in her own behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On 2 April 1987, the separation authority directed that the applicant be discharged with an uncharacterized discharge.

         b. On 6 April 1987, the applicant was discharged with an uncharacterized discharge. At the time of her discharge she had completed 4 months, and 5 days of active military service.

         c. The applicant’s unit commander initiated separation action on the applicant, under the provisions of Chapter 11, AR 635-200 by reason of entry level separation, based on her lack of motivation to complete basic training and her statements to the effect that she would do anything to get out of the Army. Throughout the process the applicant continued to express her desire to leave the service and stated that she had joined for the wrong reasons and would not comply with training standards. She was counseled on the impact of an entry level separation on three separate occasions and responded by concurring with the action and expressing her desire to be discharged.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) and (2) The issue is rejected. The Board noted the applicant’s contentions, as outlined in the statement enclosed with her application, that, in effect, she feels that she was improperly discharged because she was unaware of the consequences of the action; and that she was injured and unable to complete training. However, these contentions are not supported by either the independent evidence submitted by the applicant or the evidence of record. The record reflects that the applicant was more than adequately counseled on the fact that she was being considered for an entry level separation with an uncharacterized description of service. The applicant authenticated, with her signature, these counseling statements, issued by the chain of command, and concurred with the recommended action, and expressed her desire to be discharged. The record also reflects that the applicant consulted with legal counsel, was advised of the basis for the separation action and its impact, and that she elected not to rebut the action or to submit a statement in her own behalf. Further, an uncharacterized discharge simply means that the soldier was in an entry level status which is considered a probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. The Board, being convinced that the characterization of service and the reason for discharge were) was proper and equitable, voted to deny relief.


         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
