THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of Permanent Orders (PO) Numbers 218-008 and 008-003 from his official military personnel file (OMPF).  

2.  The applicant states three separate Army Good Conduct Medal orders for the same period were uploaded into his Interactive Personnel Electronic Records Management System (iPERMS) file.  PO Numbers 218-008 and 008-003, dated 6 August 2007 and 8 January 2008, respectively, are for the same period.  PO Number 115-0025, dated 25 April 2006, is the correct order he received for the Army Good Conduct Medal.  This should be the only order uploaded into his military records.  His gaining unit did not see an Army Good Conduct Medal in his records and decided to issue him the award.  He is unaware as to why that same unit would issue another set of orders for the same unit.  All of this was done without his knowledge.

3.  The applicant provides copies of PO Numbers 115-0025, 218-008, and 008-003.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 24 June 2003.  He was awarded military occupational specialty 35F (intelligence analyst).

2.  He provided copies of the following:
* PO Number 115-0025, issued by the U.S. Army Signal Center and Fort Gordon, GA, on 25 April 2006, awarding him the Army Good Conduct Medal (1st Award) for the period 24 June 2003 through 23 June 2006
* PO Number 218-008, issued by the U.S. Army Central Command, FL, on 6 August 2008, awarding him the Army Good Conduct Medal (1st Award) for the period 24 June 2003 through 23 June 2006
* PO Number 008-003, issued by the U.S. Army Central Command, FL, on 8 January 2008, awarding him the Army Good Conduct Medal (1st Award) for the period 24 June 2003 through 23 June 2006

3.  He was released from active duty on 13 April 2009 to accept a commission or warrant in the Army.  His DD Form 214 lists the Army Good Conduct Medal.
He was appointed in the U.S. Army Reserve, as a warrant officer one, on 14 June 2009.

4.  A review of his record located on the iPERMS revealed all three orders for the Army Good Conduct Medal are filed on the performance folder.

5.  Army Regulation 600-8-104 (Army Military Human Resource Records) prescribes the policies governing the OMPF and composition.  The regulation states once a document is placed in the OMPF it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was awarded the Army Good Conduct Medal (1st Award) for the period 24 June 2003 through 23 June 2006 on three separate orders.  A review of his records located on iPERMS revealed all three orders.

2.  In view of the foregoing, he is entitled to correction of his records located on iPERMS by the revocation and removal of PO Numbers 218-008 and 008-003 awarding him the Army Good Conduct Medal (1st Award) for the same period.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* revoking PO Numbers 218-008 and 008-003, dated 6 August 2007 and 8 January 2008, respectively
* removing/deleting these orders and the revocation orders from his records located on iPERMS
