Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal of an Army Achievement Medal (AAM) and a
duplicate award of the Army Good Conduct Medal (AGCM).
2. The applicant submits two DD Forms 149. On the first application, the
applicant states, in effect, that he was awarded the Army Commendation
Medal for meritorious service on 3 May 2000. He explains that when the
certificate for this award was completed, the certificate was typed as the
Army Achievement Medal instead of the Army Commendation Medal (ARCOM).
3. The applicant further states that he noticed the problem shortly after
the awards ceremony and the problem was corrected by reprinting the
certificate with an ARCOM. However, upon reviewing his Official Military
Personnel File (OMPF), he noticed that the incorrect certificate was posted
to his OMPF as well as the ARCOM.
4. On the second application, the applicant states that Order Number 202-
003, [Personnel Services Battalion, Fort Lewis, Washington] dated 20 July
2000 pertaining to his award of the AGCM (2nd Award) should be removed
because he was awarded the AGCM for the same period by mistake. The
applicant also states that related revocation orders, Order Number 75-001,
[22nd Personnel Services Battalion, Fort Lewis, Washington] dated 15 March
2004, should also be removed from his Official Military Personnel File
(OMPF).
5. The applicant provides:
a. A DA Form 638.
b. A Certificate for the Army Commendation Medal, dated 3 May 2000.
c. Permanent Orders Number 166-24, 510th Personnel Services
Battalion, Vicenza, Italy, dated 15 June 1999.
d. Permanent Order 202-003, 22nd Personnel Services Battalion,
Fort Lewis, Washington, dated 20 July 2000.
e. Orders Number 75-001, 22nd Personnel Services Battalion, Fort
Lewis, Washington, dated 15 March 2004.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 3 September 1992. He has
served continuously on active duty and is currently assigned to Fort
Belvoir, Virginia.
2. The applicant’s record shows he was awarded the ARCOM on 2 June 1999
for meritorious service during the period 15 July 1996 to 14 July 1999. He
was also awarded his 2nd ARCOM on 3 May 2000 for the exceptionally
meritorious service during the period 20 March 2000 to 28 April 2000; his
third for the period 1 October 2003 to 31 August 2004, and his fourth for
the period 1 September 2004 to 5 March 2006 (although the year appears to
be an error).
3. The applicant’s record shows that he was awarded the AAM for the
periods
7 January 1994 to 14 June 1996 and 6 through 16 April 1996. On 3 May 2000,
the applicant was also awarded the AAM for the period 20 March 2000 to 28
April 2000. However, this is the same period as his award for the ARCOM.
4. The applicant’s record shows that he was awarded the AGCM (1st Award)
for the periods 12 August 1993 to 11 August 1996, AGCM (2nd Award) for the
period 12 August 1996 to 11 August 1999, a second AGCM (2nd Award) was
granted on 20 July 2000 for the same period, AGCM (3rd Award) for the
period 12 August 1999 to 11 August 2002, and the AGCM (4th Award) for the
period 12 August 2002 to 11 August 2005.
5. The applicant provided Orders Number 75-001, 22nd Personnel Services
Battalion, Fort Lewis, Washington, dated 15 March 2004. These orders
revoked Orders Number 202-003, 22nd Personnel Services Battalion, Fort
Lewis, Washington, dated 20 July 2004. The OMPF available to the Board
does not contain these orders.
6. The applicant provided a copy of a DA Form 638. This form shows in
item
10 (Recommended Award) that the applicant was recommended for the ARCOM.
This form shows on page 2 that the ARCOM was the approved award and does
not show that this award was downgraded. The applicant also provided the
accompanying certificate for the ARCOM.
7. Army Regulation 600-8-22 (Military Awards) provides that the ARCOM may
be awarded to any member of the Armed Forces of the United States who,
while serving in any capacity with the Army after 6 December 1941,
distinguished himself or herself by heroism, meritorious achievement or
meritorious service. As with all personal decorations, formal
recommendations, approval through the chain of command, and announcement in
orders are required.
8. Army Regulation 600-8-22 (Military Awards) states the AGCM is awarded
to individuals who distinguish themselves by their conduct, efficiency and
fidelity during a qualifying period of active duty enlisted service. This
period is normally 3 years or, for the first award only, upon termination
of service of on or after 27 June 1950 of less than 3 years but more
than 1 year.
DISCUSSION AND CONCLUSIONS:
1. The applicant received numerous awards of the AGCM, AAM, and the ARCOM
during the period 18 December 1996 through 5 March 2005.
2. Evidence of record shows the applicant received duplicate awards of the
AGCM. He was originally awarded the AGCM (2nd Award) on 15 June 1999. He
then transferred to Fort Lewis and was awarded the AGCM (2nd Award) for the
same period. There are no revocation orders in the OMPF available to the
Board. Therefore, Permanent Order Number 202-003, dated 20 July 2000, is a
duplicate award and should be removed to include any future references to
these orders to include revocation Orders 75-001, dated 15 March 2004 if
applicable.
3. Permanent Orders Number 124-3, Headquarters, 1st Personnel Group, Fort
Lewis, dated 3 May 2000 awarded the applicant the ARCOM for the period
20 March 2000 to 28 April 2000. However, it appears an error was made on
the award certificate and the AAM was typed instead of the ARCOM. The
applicant’s records contain both the ARCOM and the AAM for the same period.
Therefore,
the certificate showing the AAM for the period 20 March to 28 April 2000
should be removed from the applicant’s record.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
removing the award certificate pertaining to the AAM for the period 20
March 2000 to 28 April 2000, and removing the Good Conduct Medal (2nd
Award), Permanent Order Number 202-003, dated 20 July 2000 to include any
related references to Permanent Order Number 202-003.
