THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of Permanent Order Number 168-13, dated 17 June 2005, awarding him the Army Good Conduct Medal (1st Award) from his official military personnel file (OMPF).

2.  The applicant states there are currently two orders in his OMPF that awarded him the 1st Award of the Army Good Conduct Medal.  The first order, dated 22 July 2002, is correct but the second one is not.  Permanent Order Number 245-02, dated 2 September 2005, corrected the error; but the order dated 17 June 2005 is still in his record.

3.  The applicant provides three orders.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show he enlisted in the Regular Army on 18 June 1999 and he held military occupational specialty 25B (Information Technology Specialist).  He is assigned to Headquarters, U.S. Army Europe, Heidelberg, Germany.

2.  His records contain the following:

* Permanent Orders Number 203-27, dated 22 July 2002, issued by the 516th Personnel Services Battalion, Camp Humphreys, Korea, awarded him the Army Good Conduct Medal (1st Award) for the period 18 June 1999 to 17 June 2002
* Permanent Order Number 168-13, dated 17 June 2005, issued by the 516th Personnel Services Battalion, awarded him the Army Good Conduct Medal (1st Award) for the period 18 June 2002 to 17 June 2005
* Permanent Order Number 245-02, dated 2 September 2005, issued by the 516th Personnel Services Battalion, awarded him the Army Good Conduct Medal (2nd Award) for the period 18 June 2002 to 17 June 2005

3.  There is no order in his OMPF that revokes Permanent Order
Number 168-13.

4.  Army Regulation 600-8-104 (Military Personnel Information Management/Records), chapter 2, governs the composition of the OMPF and states the performance section is used for filing performance, commendatory, and disciplinary data.  Once placed in the OMPF, the document becomes a permanent part of that file.  The document will not be removed from or moved to another part of the OMPF unless directed by certain agencies, to include this Board.

DISCUSSION AND CONCLUSIONS:

The evidence of record shows the applicant was erroneously issued a second order for the 1st Award of the Army Good Conduct Medal.  A subsequent order corrected this by awarding him the 2nd Award of the Army Good Conduct Medal.  However, the erroneous order was never revoked and remains in his OMPF.  Therefore, the applicant is entitled to correction of his records by removing the erroneous order.

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* removing Permanent Order Number 168-13 from his OMPF
* ensuring the copy of Permanent Order Number 168-13 he submitted with his application is not filed in his OMPF
