RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 3 April 2008 DOCKET NUMBER: AR20080003737 I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. Ms. Catherine C. Mitrano Director Mrs. Nancy L. Amos Analyst The following members, a quorum, were present: Ms. Carmen Duncan Chairperson Ms. LaVerne M. Douglas Member Mr. Jeffrey C. Redmann Member The Board considered the following evidence: Exhibit A - Application for correction of military records. Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that permanent order 30-9, dated 30 January 2002, which awarded her the Army Good Conduct Medal (3d Award), be removed from her Official Military Personnel File (OMPF). 2. The applicant states that she was awarded the Army Good Conduct Medal (3d Award) twice, for two different dates. 3. The applicant provides an email, dated 27 February 2007; two Army Good Conduct Medal orders; and orders revoking one of those Army Good Conduct Medal orders. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 24 March 1992. 2. The applicant was awarded the Army Good Conduct Medal (1st Award) for the period 24 March 1992 through 23 March 1995. She was awarded the Army Good Conduct Medal (2d Award) for the period 24 March 1995 through 23 March 1998. 3. Headquarters, U. S. Army Air Defense Artillery Center and Fort Bliss Permanent Order 30-9, dated 30 January 2002, awarded the applicant the Army Good Conduct Medal (3d Award) for the period 23 March 1998 through 22 March 2001. These orders were revoked by Task Force 261st Multifunctional Medical Battalion Permanent Orders 059-001, dated 28 February 2008. 4. Charlie Detachment, 516th Personnel Services Battalion Order 71-14, dated 12 March 2003, awarded the applicant the Army Good Conduct Medal (3d Award) for the period 24 March 1998 to 23 March 2001. 5. A review of the applicant’s OMPF on the Integrated Personnel Electronic Records Management System revealed a copy of the 30 January 2002 Army Good Conduct Medal orders. The revocation orders are not yet filed on her OMPF. 6. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) provides policies, operating tasks, and steps governing the OMPF. Table 2-1 states award orders are filed in the performance section of the OMPF. DISCUSSION AND CONCLUSIONS: 1. The regulatory guidance is to file award orders in the performance section of the OMPF. 2. However, there is a viable reason for removing Headquarters, U. S. Army Air Defense Artillery Center and Fort Bliss Permanent Order 30-9, dated 30 January 2002, and removing Task Force 261st Multifunctional Medical Battalion Permanent Orders 059-001, dated 28 February 2008, from the applicant’s OMPF (or ensuring that the latter orders are not filed in her OMPF). These two orders offer no relevant information regarding the applicant's service, conduct, or duty performance. Moreover, removing them would eliminate the potential for confusion to officials authorized to review the performance section of the applicant's OMPF. BOARD VOTE: __cd____ __lmd__ __jcr___ GRANT FULL RELIEF ________ ________ ________ GRANT PARTIAL RELIEF ________ ________ ________ GRANT FORMAL HEARING ________ ________ ________ DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing Headquarters, U. S. Army Air Defense Artillery Center and Fort Bliss Permanent Order 30-9, dated 30 January 2002, and removing Task Force 261st Multifunctional Medical Battalion Permanent Orders 059-001, dated 28 February 2008, from her OMPF (or ensuring that the latter orders are not filed in her OMPF). ___Carmen Duncan______ CHAIRPERSON
