IN THE CASE OF:
BOARD DATE: 16 July 2009
DOCKET NUMBER: AR20090004781
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his primary military occupational specialty (MOS) as 63B1O (Light Wheel Vehicle Mechanic).
2. The applicant states that he attended and completed advanced individual training (AIT) for MOS 63B1O, but his DD Form 214 shows MOS 63D1O (Artillery Mechanic).
3. The applicant provides copies of his DD Form 214 and a United States Army Training Center diploma for completion of the Light Wheel Vehicle Mechanics Course at Fort Jackson, South Carolina, dated 19 January 2001, in support of his application.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a
substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was a specialist, pay grade E-4, in the Texas Army National Guard at the time of his application.
3. On 24 July 2000, the applicant enlisted in the Regular Army. On 19 January 2001, he completed the Light Wheel Vehicle Mechanics Course for award of MOS 63B1O.
4. On 1 April 2002, the applicant was advanced to the rank of specialist, pay grade E-4, in the primary MOS 63B1O.
5. On 6 November 2005, the applicant was released from active duty and transferred to the United States Army Reserve Control Group (Reinforcement). He had completed 5 years, 3 months, and 13 days of creditable active duty.
6. Item 11 (Primary Specialty) of the applicant's DD Form 214 shows 63D1O, Artillery Mechanic, 4 years and 11 months. Item 14 (Military Education) of this same form does not show completion of any training as an Artillery Mechanic.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends that his DD Form 214 should be corrected to show his primary MOS 63B1O.
2. The available evidence clearly shows that the applicant successfully completed military training as a light wheel vehicle mechanic and was awarded MOS 63B1O. He was subsequently promoted in this MOS to specialist, pay grade E-4.
3. There is no available evidence showing that he completed any military education or on-the-job training as an artillery mechanic. There is no available evidence showing that he was ever awarded MOS 63D1O.
4. In view of the above, the applicant's DD Form 214 should be corrected to show his primary specialty as 63B1O.
BOARD VOTE:
___x_____ ____x____ ___x_____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. deleting from item 11 of his DD Form 214 the entry "63D1O00 Artillery Mechanic - 4 years 11 months" and
b. adding to item 11 of his DD Form 214 the entry "63B1O00 Light Wheel Vehicle Mechanic - 4 years 11 months."

The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show his primary military occupational specialty (PMOS) as 11B (Infantryman). It further stated that the applicants records do not show that he received the required training to hold 11B as a PMOS. The evidence of record clearly shows the applicants PMOS was 63B and that he was never awarded an infantry PMOS.
ARMY | BCMR | CY2011 | 20110009214
The applicant provides his DD Form 214. The DD Form 214 he was issued for this period of service shows in Block 11 his PMOS as 88M and indicates he served as such for 2 years and 7 months. The evidence of record show that as of 5 March 2004 he had held and served in PMOS 88M for 2 years and 7 months and PMOS 63B for 5 years and 6 months.

Army Regulation 635-5 states, in pertinent part, that item 14 will list formal in-service training courses of 40 hours or more successfully completed during the period of service covered by the DD Form 214. It is awarded to members of Active Army, Army National Guard, and U.S. Army Reserve Soldiers for successful completion of designated NCO professional development courses. The evidence of record shows the applicant was promoted to sergeant in July 2003 and was awarded primary MOS 63Y2O...

The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show his military occupational specialty (MOS) as 63B2O, and his last unit of assignment as the 227th General Supply Company. The EPMS requires that the MOS skill level (fourth character) be in agreement with the individual's rank and pay grade. There is no available evidence of record, or evidence provided by the applicant, showing that he is entitled to any award not already...

The applicant requests that his Certificate of Release or Discharge From Active Duty (DD Form 214) be corrected to show that he served in the Army in a light wheel vehicle mechanic (63B1O) Military Occupational Specialty (MOS). There is no evidence in the available records that shows that the applicant ever served in a 63H1O MOS while he was in the Army. The evidence of record clearly shows that he served in a 63W1O MOS while he was on active duty in the Army.
ARMY | BCMR | CY2014 | 20140009503
The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the correct amount of time for each military occupational specialty (MOS) listed. A calculation of the time the applicant held/served in each MOS of record shows the following: 1997 06 30 date retired from active duty - 1977 08 30 date awarded MOS 63B = 19 10 00 or 19 years and 10 months (MOS 63B) 1997 06 30 date retired from active duty - 1982 06 24 date awarded MOS 72E = 15...
ARMY | BCMR | CY2013 | 20130009401
The applicant requests promotion to the pay grade of E-5. Although not specified in the available records, it appears that the orders promoting the applicant to the pay grade of E-5 were erroneously published as they showed that he was being promoted in the primary MOS of 25U2O (Signal Support Systems Specialist). While it is regrettable that the applicants promotion was revoked, the orders clearly state that the promotion was not valid if he was not in a promotable status and it shows...

Application for correction of military records (with supporting documents provided, if any). The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Army Good Conduct Medal and the Army Achievement Medal and his secondary military occupational specialty (SMOS) 63B (Light Vehicle Wheel Mechanic). As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: *...

The applicant requests, in effect, that his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 7 December 1982 be corrected to show he entered active duty on 13 December 1977 and separated on 7 December 1981. The applicant states that he needs his DD Form(s) 214 to reflect accurate dates of service and the Purple Heart for Department of Veterans Affairs benefits. This DD Form 214 shows his MOS as 63C1O and shows he had not been awarded any awards or...
ARMY | BCMR | CY2006 | 20060000799C070205
The applicant requests his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show his military occupational specialty (MOS) as 76P (Stock Control and Accounting Specialist) not 63C (Wheel Vehicle Mechanic). Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect, indicates the required entry in item 23a is the primary MOS the Soldier was awarded and was serving in at the time of separation. The preponderance of evidence...
