IN THE CASE OF:
BOARD DATE: 17 July 2008
DOCKET NUMBER: AR20080003912
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show his primary military occupational specialty (PMOS) as 11B (Infantryman).
2. The applicant states that he served overseas in an infantry position and did not perform vehicle maintenance.
3. The applicant provides no supporting documents.
CONSIDERATION OF EVIDENCE:
1. On 29 January 2003, the applicant enlisted in the California Army National Guard. He completed the 19 week Light Wheeled Vehicle Mechanic Course in August 2003 and was awarded PMOS 63B.
2. On 24 October 2004, the applicant was ordered to active duty in support of Operation Enduring Freedom. He served in Kosovo from 8 February 2005 to
12 January 2006. He served with the 160th Mechanized Infantry Battalion.
3. On 8 February 2006, the applicant was released from active duty. He had attained the rank of specialist, pay grade E-4, and had completed 1 year,
3 months, and 15 days of creditable active duty during this period.
4. Item 11 (Primary Specialty) of the applicants DD Form 214 shows his PMOS as 63B1O, Wheeled Vehicle Mechanic, and that he held this PMOS for 1 year and 3 months.
5. On 27 December 2006, the applicant was discharged from the California Army National Guard and transferred to the United States Army Reserve Control Group (Annual Training).
6. Item 13 (Primary Specialty Number, Title and Date Awarded) of the applicants NGB Form 22 (Report of Separation and Record of Service) shows his PMOS as 63B1O, and that it was awarded to him on 26 August 2003.
7. In the processing of this case, an advisory opinion was obtained from the Career Management Officer, Force Sustainment, United States Army Human Resources Command, St. Louis, Missouri. It stated, in effect, that the applicants PMOS was 63B1O and that while deployed he had served with an infantry unit in an infantry position. It further stated that the applicants records do not show that he received the required training to hold 11B as a PMOS.
8. On 6 May 20078, a copy of the advisory opinion was sent to the applicant for his information and opportunity to rebut. No response was received.
9. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214. It provides, in pertinent part that Item 11 (Primary Specialty) will show the Soldiers military occupational specialties that he held for periods of 1 or more years.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record clearly shows the applicants PMOS was 63B and that he was never awarded an infantry PMOS. While he did serve in an infantry position while deployed, this service did not qualify him for award of 11B as his PMOS.
2. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.
3. In view of the foregoing, there is no basis for granting the applicant's request.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
___X____ ___X____ ___X____ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The applicant provides his DD Form 214. The DD Form 214 he was issued for this period of service shows in Block 11 his PMOS as 88M and indicates he served as such for 2 years and 7 months. The evidence of record show that as of 5 March 2004 he had held and served in PMOS 88M for 2 years and 7 months and PMOS 63B for 5 years and 6 months.

The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the correct amount of time for each military occupational specialty (MOS) listed. A calculation of the time the applicant held/served in each MOS of record shows the following: 1997 06 30 date retired from active duty - 1977 08 30 date awarded MOS 63B = 19 10 00 or 19 years and 10 months (MOS 63B) 1997 06 30 date retired from active duty - 1982 06 24 date awarded MOS 72E = 15...

The applicant requests promotion to the pay grade of E-5. Although not specified in the available records, it appears that the orders promoting the applicant to the pay grade of E-5 were erroneously published as they showed that he was being promoted in the primary MOS of 25U2O (Signal Support Systems Specialist). While it is regrettable that the applicants promotion was revoked, the orders clearly state that the promotion was not valid if he was not in a promotable status and it shows...

Item 22 (Military Occupational Specialties) of the applicant's DA Form 20 (Enlisted Qualification Record) shows he was awarded primary MOS (PMOS) 63C2O (General Vehicle Repairman) on 4 December 1970 and MOS 63B2O became his secondary MOS. Based on the evidence of record, the applicant's PMOS upon separation was 63C as awarded through the publication of permanent military orders. Since only the PMOS is authorized for entry on the DD Form 214, his DD Form 214 correctly shows 63C as his PMOS.
