IN THE CASE OF: BOARD DATE: 17 July 2008 DOCKET NUMBER: AR20080003912 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show his primary military occupational specialty (PMOS) as 11B (Infantryman). 2. The applicant states that he served overseas in an infantry position and did not perform vehicle maintenance. 3. The applicant provides no supporting documents. CONSIDERATION OF EVIDENCE: 1. On 29 January 2003, the applicant enlisted in the California Army National Guard. He completed the 19 week Light Wheeled Vehicle Mechanic Course in August 2003 and was awarded PMOS 63B. 2. On 24 October 2004, the applicant was ordered to active duty in support of Operation Enduring Freedom. He served in Kosovo from 8 February 2005 to 12 January 2006. He served with the 160th Mechanized Infantry Battalion. 3. On 8 February 2006, the applicant was released from active duty. He had attained the rank of specialist, pay grade E-4, and had completed 1 year, 3 months, and 15 days of creditable active duty during this period. 4. Item 11 (Primary Specialty) of the applicant’s DD Form 214 shows his PMOS as 63B1O, Wheeled Vehicle Mechanic, and that he held this PMOS for 1 year and 3 months. 5. On 27 December 2006, the applicant was discharged from the California Army National Guard and transferred to the United States Army Reserve Control Group (Annual Training). 6. Item 13 (Primary Specialty Number, Title and Date Awarded) of the applicant’s NGB Form 22 (Report of Separation and Record of Service) shows his PMOS as 63B1O, and that it was awarded to him on 26 August 2003. 7. In the processing of this case, an advisory opinion was obtained from the Career Management Officer, Force Sustainment, United States Army Human Resources Command, St. Louis, Missouri. It stated, in effect, that the applicant’s PMOS was 63B1O and that while deployed he had served with an infantry unit in an infantry position. It further stated that the applicant’s records do not show that he received the required training to hold 11B as a PMOS. 8. On 6 May 20078, a copy of the advisory opinion was sent to the applicant for his information and opportunity to rebut. No response was received. 9. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214.  It provides, in pertinent part that Item 11 (Primary Specialty) will show the Soldier’s military occupational specialties that he held for periods of 1 or more years. DISCUSSION AND CONCLUSIONS: 1. The evidence of record clearly shows the applicant’s PMOS was 63B and that he was never awarded an infantry PMOS. While he did serve in an infantry position while deployed, this service did not qualify him for award of 11B as his PMOS. 2. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy the aforementioned requirement. 3. In view of the foregoing, there is no basis for granting the applicant's request. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. ________ _ X_______ ____ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
