		IN THE CASE OF:

		BOARD DATE: 12 March 2009

		DOCKET NUMBER: AR20090000132

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that Permanent Orders 268-002, dated 24 September
2008, awarding a fourth award of the Good Conduct Medal be removed from her record.

2. The applicant states that this is a duplicate of Permanent Orders 342-13, dated 8 December 2005.

3. The applicant provides, in support of her application, copies of the two orders.

CONSIDERATION OF EVIDENCE:

1. The applicant, a career Regular Army noncommissioned officer, was awarded the Army Good Conduct Medal (4th Award) for the period from 8 September
2002 to 7 September 2005 by U.S. Army Garrison-Redstone, Redstone Arsenal, Alabama, Permanent Orders 342-13, dated 8 December 2005.

2. The applicant was again awarded the Army Good Conduct Medal (4th Award) for the period from 8 September 2002 to 7 September 2005 by 95th Adjutant General Battalion (Reception), Fort Sill, Oklahoma, Permanent Orders 268-002, dated 24 September 2008.

3. The applicant was awarded the Army Good Conduct Medal (5th Award) for the period from 8 September 2005 to 7 September 2008 by 95th Adjutant General Battalion (Reception), Fort Sill, Oklahoma, Permanent Orders 268-001, dated 24 September 2008.
DISCUSSION AND CONCLUSIONS:

1. The applicant contends that Permanent Orders 268-002 duplicates Permanent Orders 342-13.

2. It appears that the 95th Adjutant General Battalion (Reception) published Permanent Orders 268-002 awarding the applicant the Army Good Conduct Medal (4th Award) at the time the reception battalion published orders awarding her the Army Good Conduct Medal (5th Award) in the absence of the previously published orders by U.S. Army Garrison-Redstone.

3. 95th Adjutant General Battalion (Reception) Permanent Orders 268-002, dated 24 September 2008, duplicates the award accomplished by U.S. Army Garrison-Redstone Permanent Orders 342-13, dated 8 December 2005, and should, therefore, be revoked and removed from the applicant's records.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by revoking and removing 95th Adjutant General Battalion (Reception) Permanent Orders 268-002, dated 24 September 2008, and by ensuring that the revocation orders are not filed in the applicant's records.
