IN THE CASE OF:
BOARD DATE: 07 AUGUST 2008
DOCKET NUMBER: AR20080011405
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that the orders awarding him the Army Good Conduct Medal (GCMDL) (2nd Award), dated 10 December 2002 be removed from his Official Military Personnel File (OMPF).
2. The applicant states that his OMPF contains two sets of orders awarding him the second award of the GCMDL and he desires to have the latest set, dated
10 December 2002 removed from his OMPF.
3. The applicant provides copies of the two GCMDL orders in question.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 2 January 1992 for a period of 5 years and training as a military policeman. He has remained on active duty through a series of continuous reenlistments and was promoted to the pay grade of E-7 on 1 March 2004.
2. On 27 October 1997, while stationed in Italy in the pay grade of E-5, Detachment D, 510th Personnel Services Battalion Permanent Orders 300-25 was published awarding the applicant the second award of the GCMDL for the period of 2 January 1995 through 1 January 1998.
3. On 10 December 2002, while stationed at Fort Jackson, South Carolina in the pay grade of E-6, E Company, 1st Battalion, 61st Infantry Regiment Permanent Order Number 344-01 was published awarding the applicant the second award of the GCMDL for the same period of service.
DISCUSSION AND CONCLUSIONS:
1. Inasmuch as there are two orders awarding the applicant the second award of the GCMDL for the same exact period, it must be presumed that an administrative error was made at the time the second set of orders were published at Fort Jackson on 10 December 2002.
2. Accordingly, it would be in the interest of justice at this time to revoke Permanent Order Number 344-01, dated 10 December 2002 and remove it from his OMPF.
BOARD VOTE:

He goes on to state that one order for the 3rd award and one order for the 6th award of the GCMDL should be removed from his OMPF and revoked. The applicant provides a personnel records request form and copies of all orders awarding him the GCMDL. Accordingly, action should be taken to revoke Permanent Orders 101-689 dated 11 April 2001 (3rd Award) and Permanent Orders 085-03 dated 31 March 2008 (6th Award), which are both duplicate orders contained in his OMPF.

The applicant requests that his records be corrected by removing duplicate orders authorizing award of the third and fourth Good Conduct Medals and the revocation orders for these duplicate orders. However, the retention of the duplicate orders for the awards and the orders revoking those orders in his permanent file might create an illusion that something improper occurred or result in confusion as to correct periods and dates of award of the Good Conduct Medals. The Board further...

The applicant requests removal from his Official Military Personnel File (OMPF) the duplicate set of orders awarding him the first award of the Good Conduct Medal (GCMDL). There are no orders or other evidence in the applicant's OMPF to show that either of the orders awarding him the GCMDL (1st Award) were revoked. The applicant requests, in effect, that an order awarding her the Good Conduct Medal (GCM) and its subsequent revocation order be removed from her Official Personnel Military File (OPMF). The service start date of 1 October 1996 is the date the applicant enlisted in the Regular Army and this date does not take into consideration the applicant's computed active duty service date which is 18 May 1996. The two award orders are permanent documents, which by regulatory guidance must be filed in...

The applicant requests, in effect, that Permanent Orders Number 84-01 and 84-03 dated 25 March 1999, awarding him the Army Good Conduct Medal for the 2nd and 3rd award be removed from his Official Military Personnel File (OMPF). This regulation also provides that once filed such documents become a permanent part of the OMPF and may only be removed by one of several agencies, one of which is the Army Board for Correction of Military Records (ABCMR). It is evident that the orders which the...
ARMY | BCMR | CY2010 | 20100008006
The applicant requests removal from her Official Military Personnel File (OMPF) the duplicate set of orders awarding her the third award of the Good Conduct Medal (GCMDL). There are no orders or other evidence in the applicant's OMPF to show that either of the orders awarding her the GCMDL (3rd Award) were revoked. Therefore, it would be appropriate to revoke the second (duplicate) order that was issued awarding the applicant the GCMDL (3rd Award) for the same period of service.
