THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that Permanent Orders Number 84-01 and 84-03 dated 25 March 1999, awarding him the Army Good Conduct Medal for the 2nd and 3rd award be removed from his Official Military Personnel File (OMPF). 

2.  The applicant states, in effect, that his OMPF has two awards of the Army Good Conduct Medal that are incorrect.  Permanent Orders Number  
84-01 shows the award for the Army Good Conduct Medal as "(2nd AWD)"; however, it should be the 1st AWD.  Secondly, Permanent Orders Number  
84-03 shows the award for the Army Good Conduct Medal as "(3rd AWD)"; however, it should be the 2nd AWD.  Proper orders for the 1st and 2nd award of the Army Good Conduct Medal have been issued.  He tried numerous times to have the erroneous orders removed to no avail.  He would like to have the incorrect orders and revocation orders removed from his OMPF, because they can effect how the promotion board views his ability to maintain his own records.

3.  The applicant provides two copies of Detachment A (Babenhausen Squad), 55th Personnel Services Battalion (PSB) Permanent Orders Number  
298-01, dated 25 October 1999 and Permanent Orders Number 288-01, dated  
15 October 1999, that awarded him the Army Good Conduct Medal for the  
1st and 2nd award, and two orders revoking Permanent Orders 84-01 and 84-03.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military personnel record shows he enlisted in the Regular Army on 1 February 1993 for a period of 4 years.  He served continuously on active duty in the military occupational specialties (MOSs) 76C (Equipment Records and Parts Specialist) and 92A (Automated Logistical Specialist).

2.  On 13 January 1997, the applicant was assigned to the 77th Maintenance Company, Babenhausen, Germany.

3.  Detachment A (Babenhausen Squad), 55th PSB Permanent Orders Number 84-01, dated 25 March 1999 awarded the applicant the Army Good Conduct Medal (2nd AWD) for the period of service from 1 February 1993 to 31 January 1996.

4.  Detachment A (Babenhausen Squad), 55th PSB Permanent Orders Number 84-03, dated 25 March 1999 awarded the applicant the Army Good Conduct Medal (3rd AWD) for the period of service from 1 February 1996 to 31 January 1999.

5.  Headquarters, Group Support Battalion, 1st Special Forces Group (Airborne) Permanent Orders Number 129-02 and 129-01, dated 8 May 2008, revoked Detachment A (Babenhausen Squad), 55th Personnel Services Battalion Permanent Orders Number 84-01 and 84-03.

6.  A review of the applicant's OMPF shows that Detachment A (Babenhausen Squad), 55th PSB Permanent Orders Number 298-01 for the period from
1 February 1993 to 31 January 1996 and Permanent Orders Number 288-01 for the period from 1 February 1996 to 31 January 1999 are currently on file in his OMPF.  Additionally, Permanent Orders Number 325-024, dated 21 November 2001 for award of the Army Good Conduct Medal (3rd AWD) for the period of service from 31 January 1999 to 30 January 2002 is currently filed in his OMPF.

7.  Army Regulation 600-8-104 (Military Personnel Information Management/ Records), provides in Table 2-1 (Composition of the OMPF) that award orders are filed in the Commendatory and Disciplinary portion of the OMPF.  This regulation also provides that once filed such documents become a permanent part of the OMPF and may only be removed by one of several agencies, one of which is the Army Board for Correction of Military Records (ABCMR).

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that Permanent Orders Number 84-01 and 84-03, dated 25 March 1999 should be removed from his OMPF.

2.  It is evident that the orders which the applicant has requested to be removed from his records erroneously cited the wrong award of the Army Good Conduct Medal.  Because of those errors, those orders were revoked.

3.  The erroneous orders and the revocation of those orders have no historical value in documenting the applicant's military career.  The applicant's OMPF is not considered the appropriate place to document this error for historical purposes.

4.  Therefore, it is appropriate to remove Detachment A (Babenhausen Squad), 55th PSB Permanent Orders Number 84-01 and 84-03, from the applicant's OMPF.  In addition, it would also be appropriate to remove Headquarters, Group Support Battalion, 1st Special Forces Group (Airborne) Permanent Orders Number 129-02 and 129-01 from the applicant’s OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing Detachment A (Babenhausen Squad), 55th PSB Permanent Orders 
Number 84-01 and 84-03 and Headquarters, Group Support Battalion,  
1st Special Forces Group (Airborne) Permanent Orders Number 129-02 and  
129-01 from the applicant’s OMPF.
