GENERAL: The applicant appeals for upgrade of discharge to Honorable, to change the reason and authority for the discharge, and to change the reenlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge. The change of reason and authority for discharge, and change of reenlistment code are denied.

The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and after a thorough review of the record , the Board was unable to identify any that would justify a change of discharge.

ISSUE: The applicant received a General discharge for Misconduct -Minor Infractions

The Air Force Discharge Review Board, under its responsi bility to examine the propriety and equity of an applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption , to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant 's record of service included one Article 15, four Letters of Reprimand, one Letter of Admonishment , two Records of Individual Counseling, and one Letter of Counseling. His misconduct included failure to shave; failure to have his name tag for a mandatory service dress uniform inspection; receiving six Letters or Counseling within 91 days of being at station; reporting late for duty, drinking underage in addition to being found having two cases of beer in his refrigerator and three empty cans beside his bed; failure to show for ADAPT appointment (2x); failure to refrain from consuming alcohol under the age of twenty-one (2x), drove a vehicle used for emergency-only to work, and damaging the vehicle.

The applicant contends that at the time of his service he was very young and immature. He stated that his immaturity enabled him to try to fit with the older service members. The ORB recognized the applicant was 18 years of age when the discharge took place. However, there is no evidence that suggests he was immature. The Board opined the applicant was not much younger than the vast majority of first-term members who properly adhere to the Air Force's standards of conduct. The ORB opined that through the administrative actions taken, the applicant had ample opportunities to change his negative behavior. The ORB concluded that the characterization of the applicant's discharge was appropriate due to the misconduct. A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. After a thorough review of the record , the Board found no evidence to
ju stify an upgrade of the discharge characterization, reason for the discharge, or the reenlistment code.

CONCLUSION : The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation , was within the discretion of the discharge authority, and that the applicant was provided full administrative due process.

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged.
