AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUMBER

GENERAL: The applicant appeals for upgrade of discharge to Honorable and to change the reason and authority for the discharge.

The applicant appeared and testified before the Discharge Review Board (ORB), without counsel, at Andrews AFB on March 12, 2015

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge and change of reason and authority for discharge.

ISSUE: The applicant received a General discharge for Misconduct - Conduct Prejudicial to Good Order and Discipline.

The Air Force Discharge Review Board, under its responsibility to examine the propriety and equity of an Applicant 's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption , to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. In order to adhere to Mental Health Amendments to 10 USC 1553, a physician with specialized trai ning on mental heal th disorders was present for this board. The Applicant 's record of service included five Letters of Reprimand, one Letter of Counseling, and five Records of Individual Counseling. Her miscond uct included unprofessiona l and disrespectful language towards a SNCO; insubord inate attitude towards a SNCO; failure to return to duty after duty after an appointment; failure to obey a direct order (2x); failure to meet standard for a fitness assessment (2x); failure to be on time for drill (2x); m isuse of Air Force communications; unauthorized absence from duty; and failure to attend a scheduled appointment.

The applicant contends that the discharge was i nequ itable because i t was too harsh; however the Board finds that the applicant did not present or submit any issues contesting the equity or propriety of the discharge. The Board opined that through the administrative actions taken, the applicant had ample opportunities to change her negative behav ior. They found the seriousness of the willfu l misconduct offset any positive aspects of the applicant's duty perfonnance. A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. The Board reviewed the entire record and found no evidence of impropriety or inequity to warrant an upgrade of the discharge.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation, was withi n the discretion of the discharge authority, and that the applicant was prov ided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and dete1mi nes the discharge should remain unchanged.
