GENERAL: The applicant appeals for upgrade of discharge to Honorable.
The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available perti nent data on the applicant and the factors leading to the discharge.
FINDING: The Board grants the requested relief.
ISSUE: The applicant recei ved a General discharge for Misconduct - Minor Disciplinary Infractions
The Air Force Discharge Review Board, under i ts responsibility to examine the propriety and equity of an applicant's discharge, is autho1ized to change the characte1ization of service and the reason for discharge if such change is warranted. ln reviewi ng discharges, the Board presumes regularity i n the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant's record of service included two A1iicle l 5s. His misconduct included failure to refrain from climbing a water tower on base and entering a controlled area; drunk and disorderl y conduct; and disrespectful language towards two NCOs .
The applicant contends discharge was inequi table because it was based on two isolated incidents and he was not given time for probation and rehabili tation. The Board opined that the evidence contained i n the record does suppo11the applicanf s claim that the discharge was based on two isolated incidents during his career. After a thorough review of the record and the information suppl ied by the appl icant, the ORB determi ned there is sufficien t evidence to support his cla im of inequity. Although the Board does not condone applicant's misconduct , the Board finds that the applicant's work environment and lack of leadership by example within his duty section played a role in his misconduct. The Board determined that the appl icant's overall good duty performance outweighed his minor discipli nary infractions. As such, the Board grants an upgrade of discharge to Honorable.
The Discharge Review Board concl udes that the discharge was consistent with the procedural and substanti ve requirements of the discharge regu lation and was within the discretion of the discharge authority and the applicant was provided full administrati ve due process.
However, in view of the foregoi ng findi ngs, the Board concludes that the overall qua!ity of applicant" s service is more accurately reflected by an Honorable discharge under the provisions of Title 10, USC 1 553. A ttachment: Examiner's Brief |
