AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUMBER

FD-2014-00618

GENERAL: The applicant appeals for upgrade of discharge to Honorable.

The appl icant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available perti nent data on the applicant and the factors leading to the discharge.

FINDING: The Board grants the req uested relief.

ISSUE: The applicant recei ved a General discharge for Misconduct -Commission of Serious Offense

The Air Force Discharge Review Board, under its responsibility to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge i f such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumption , to include evidence subm i tted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant's record of service included two Letters of Reprimand for being atTested for domestic violence/battery and child abuse and endangennent and failing to notify leadership of multiple civilian violations since 2009.

The applicant submitted no issues regarding the inequity or impropriety of his discharge. The applicant does submit that he is requesting a change to his characterization due to civilian charges being dismissed and
there is no longer any legal case pending against him. Although the Board does not condone applicant's misconduct , the Board finds sufficient mitigation and extenuation based upon the evidence to consider his d ischarge harsh. As such, the Board grants upgrade of discharge to Honorable and change of reason and authority for discharge.

CONCLUSION: The Discharge Revie'vv Board concludes that the discharge was consistent wi th the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authori ty and the applicant was provided full administrative due process.

However, in view of the foregoing findings, the Board concludes that the overall quality of applicant's service is more accurately reflected by an Honorable discharge or the reason for the discharge is more accurately described as Secretarial Authori ty under the provisions of Title l0, USC 1553.
