GENERAL: The applicant appeals for upgrade of discharge to honorable

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors lead ing to the discharge.

FINDING: The Board denies the upgrade of the discharge.

ISSUE: Appl icant recei ved a General discharge for Misconduct - Conduct prejudicial to good order and discipl ine.

The Air Force Discharge Review Board, under i ts responsi bi lity to examine the propriety and equity of an Applicant's discharge, is authorized to change the character of service and the reason for discharge if such change is warranted. In reviewi ng discharges, the Board presumes regulari ty in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board did complete a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The Appl icant's record of service included two Article l 5s, one Letter of Reprimand and one Letter of Counsel. Her misconduct included; fai lure to go on time, use of Government Travel Card for unofficial purposes, making false official statement to a SNCO, and being Absent Without Leave for two days.

Applicant contends that her discharge should be upgraded base on the revision of AFI36-3208 , paragraph 5.36.2.2, on homosex ual conduct. The discharge package did incl ude a statement by the member that she is a homosexual, which at the time was in violation of Air Force policy however; the pri mary reason for
discharge was miscond uct. The applicant 's DD Form 214 states misconduct as the nanative reason for separation, not homosex ua l cond uct, therefore the revision to A FI36-3208 wou ld not apply. The Board reviewed the entire record and found no evidence of impropriety or ineq uity to warrant an upgrade of the discharge.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authori ty and the applicant was provided full administrative due process.

In view of the foregoi ng fi nd ings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and dete1mines the discharge should remai n unchanged.
